PRINTJNG.LITHOGRAPHIMQ.STATIO RV;OM-A <br />SIXTH <br />After the death of my wife, Magdalena Timpke, and the termination of the life estate created <br />i <br />and devised in the difth clause of this will, it is my will that all the rest, residue and <br />remainder of said estate and property, with all unexpended accretions, shall pass-in equal share4 <br />to my children, hereinafter named, and for that purpose I hereby give, devise and bequeath <br />all the rest, residue and remainder of my said estat.e, subject to said life estate and remaining, <br />after the termination and use thereof, in equal shares to my children as follol�,-s: Marie Timpke <br />Falldorf, wife of Henry Falldorf, of Grand Island, Nebraska; Emila Timp1 e Ehlers, wife of <br />Henry Ehlers, of ,,derrick County, Nebraska, Minnie Timpke Leonard, wife of James Leonard, of <br />Salt Lake City, Utah; Henry Timpke of Hall County, Nebraska; Otto Timpke, of Loveland,Colorado; <br />Caroline Tiropke Erne wife wife of Herman Egge of Hall County, Nebraska, Emma Tiqpke Parker, wife <br />of David Parker, of Hall County, Nebraska, and Fred A. Tinpke, of Hall Count,, Nebraska; And I <br />direct that if any of my said children shall be indebted to my estate at the time of my said <br />wife's death, then such indebtedness shall be considered an advancement to the amount due such <br />�child or children, and shall be retained from any amount Coming to him or them under this will <br />regardless of whether or not the said indebtedness or collections thereof, has been barred by <br />the statute of limitations, or such statute could be plead in defense to and action thereof. <br />I further direct that in case my youngest child i:& not of legal age at the time of"my said <br />wife's death, then no part of the real estate devised in this clause of my will shall be parti- <br />tioned or sold until twelve months after said youngest child shall become twenty-one years of <br />age. In case any of my said children shall die leaving issue or descendants, prior to the <br />death of myself and my said wife, I direct that his share shall not lapse but shall descend and <br />be paid to such issue or descendants in equal parts by right of representation. <br />I also direct that, if possible and feap-9able, the tract of land owned by me in Sections <br />twenty (20) and Twenty-one (21) township eleven (11), North of Range Nine (9), West, lying and <br />situate north of the said B. &. M. BELT LINE, as now located, and consisting of about sixty-fivel <br />(65) acres, be divided into eight equal tracts or parcels, and thus divided in kind between my <br />said children, each taking, by necessary releases and transfers from the others, one of said <br />tracts. This, however, is not to be considered compulsory upon said children, if, found not to <br />be feaseable or practicable, but only advisory, the said land, being adjacent to the City of <br />Grand Island, could in my opinion be profitably divided into lots as abov e indicated and held <br />by my said children in that form. <br />SEITE.NTH: <br />name, nominate and appoint my said wife; Magdalena Tirfpke, executrix of this, my last will I <br />nd testament, and having full confidence in her ability to care for and conserve the estate <br />reposed in her hands, I direct that she shall not be required to give bond as such executrix. <br />also appoint her to act as guardian of the personal property, person and estate of my said son; <br />Fred A. Tirnipke, until he shall attain his legal majority,, provided he is not of age at the time <br />of my death. <br />EI GTITH: <br />I hereby revoke all former wills by me made, including all codicils thereto. <br />In Testimony whereof I have hereunto signed my name to this, my last will and testament, <br />consisting of Five pages (including this page) of typewritten matter, all of said pages being <br />identified by my signature thereon, upon this llth day of November, A.D. 1905. <br />Henry E.
