<br />WILL OF HENRY E. TIMPKE.
<br />Henry E. Timpke., of Hall County, Nebraska, being,o""' sound mind and disposing memory, do
<br />make and publish this, my last will and testament in words as follows:
<br />FIRST:
<br />It is my will that all of my just debts, including the expenses of my last sickness and
<br />burial, be first paid out of my personal estate, and if there is not sufficient personal prop-
<br />erty for that purpose then I empower my executrix, hereinhifter named, to sell so much of my
<br />real estate, not specifically devised herein, as may be necessary for that purpose.
<br />SECCVD:
<br />Having given to all of my children, except my youngest child, Fred A. Timpke, some assistance

<br />in money, property or other benefits upon their severally coming of'age, getting married or
<br />leaving home, I hereby give and bequeath to my said son, Fred A. Timpke, the sum of Four Tlund- 7 -
<br />red Dollars 0400 00) in money, to be paid to him out of my estate -within three months after
<br />my death, provided he is of legal age at that time, and if not, then within three months after
<br />J he becomes twenty-one years of age.
<br />THIRD:
<br />I give, devise and bequeath to my said son,, Fred A. Timple, all of that part of the East half
<br />of the South-east quarter of section no. twenty, and the west half of the soutt-wes . t quarter o-'&.'
<br />section no. twenty-one (21), all in township eleven (11), North of Range Nine (9)., 'West, in
<br />hall Count-y. Nebraska, which lies and is situated south of the railroad track running east and
<br />west through said sections and known as the B. &. 11. Belt Line, as same is now located; Said
<br />tracts being a part of my old homestead and consistinc- of about one hundred acres (100) of
<br />land, a little more or less. Provided, however, and upon the express conditions that he,
<br />the said Fred A. Timpke, shall, within one year (1), after my death, if he is of legal age
<br />at that time, and if not then within one year after he becomes Twenty-one years (21). Of
<br />age, pay to my executrix, hereinafter named, for the use and benefit of my estate and to form
<br />a part of the residue thereof, the sum of Three Thousand Dollars ($$000 00) which amount is
<br />made a charge and lien upon said land and can only be released upon the payment of said amount
<br />to my said executrix, or legal representative, as herein required.
<br />FOURTH:
<br />One of my daughters, Anna Timpke Hofman, who was the wife of Carl Hofman, of Grand Island,
<br />Nebraska, perished at sea, together with her only child, in the loss of the ill-fated Elba,
<br />a number of years ago. As she has no children or descendants surviving her, and as her husband
<br />the said Carl Hofman is abundantly able to support and care for himself, as he received some
<br />advantages from advancements made to my said deceased daughter at the time of his marriage
<br />'Owith her I feel that I am under no obligatiom to make any provisions for him, but neverthe-
<br />less,, as evidence that he is not forgotten by me and of my good will toward him, I hereby
<br />olive and bequeath to him the sum of Ten Dollars ($10 00) to be paid to him within three months
<br />after my death.
<br />FIFTH:
<br />I, give, devise and bequeath to my beloved wife, Magdalena Timpke, all the rest, residue
<br />and remainder of my estate,, real., personal and mixed and wherever situate, for her sole use
<br />and benefit during her natural life. TJy intention and desire being that she shall use and
<br />enjoy the rents, income, profits, and revenue, therefrom, or so much thereof as she may need
<br />for her support, and enjoyment and comfort during life., including a sum sufficient for her
<br />burial, and after her death the residue and remainder over to be distributed as set forth in the
<br />sixth clause of this will.
