<br />The Court further finds that the said Executrix has remaining in her hands after the payment of
<br />all debts and legacies as above stated, the sum of Nine Thousand One Hundred Sixty and 9 -100

<br />and one note against Henry Falldorf and wife, and sundry other personal property, all of wrath I

<br />uunder the terms of said will shall be distributed to said executrix and held by her for her use
<br />and benefit during the remainder of her life.
<br />The Court further finds that the said Henry E. Timpke died seized of the following property
<br />situate in Hall County, Nebraska, to -wit: The East I of the South -oast � of Section 20 in Town-

<br />ship 11, Range 9, blest, containing 80 acres, and the Southwest of section 21, township 11,
<br />range 9, 'hest, in Hail County Nebraska, containing 160 acres, and the south -east � of the north-
<br />west 4 and lots No. two, three, four in section No. 11, Township 10, North, of Range 9, West,
<br />Hall County, Nebr asKa, containing 144 & 35 -100 acres. Also a part of the Northwest of sec-
<br />tion 21, township 11, north of range 9, west of the 6th P. :d. and described as follows: com-
<br />mencing at a point 511 2 feet east from the south -west corner of the Northwest 4 of Section 21,
<br />township 11, north of range 9, west of the 6t h P. M. and running thence east along the center
<br />line of said Section 21, 877.2 feet to the west line of Logan Street, if the same were extended
<br />thence in a northerly direction_ parallel with said west 2line of Logan Street 521 feet to the
<br />point of its intersection with the south line of Anna Street, thence in a southwesterly direction.
<br />along south line of said Anna Street 770. 8 feet, thence south 95 feet running parallel with the
<br />west line of Butler Street, if the same were extended, to the place of beginning, containing 5
<br />i & � acres, more or less. That by the terms-of said will all of said real estate except that

<br />hereinbefore described and passing to Fred A. Tirrpke, passed to the said Magdalena Timpke, for
<br />her sole use and benefit during her life time, and upon her death, in equal shares to his
<br />i
<br />children as follows: Marie Timpke Falldorf, Emila Timpke Ehlers, Minnie Timpke Leonard, Henry j
<br />Timpke, Caroline 'Timpke Egge, Otto Timpke, E=aa Timpke darker and Fred A. Timpke.
<br />It is therefor by the court adjudged, ordered and decreed that the final report of said
<br />executrix be and the same
<br />f er and assign to herself
<br />belonging to said estate,
<br />raining in her hands Belo:
<br />hereby is allowed and ap7roved, and she is hereby_ authorized to trans+ -

<br />all notes and other evidences of indebtedness remaining in her hands
<br />together with all securities thereof, and pay to herself all money re-

<br />nging to said estate as shown by said report, to be held by her under I
<br />the terms of said will during her life time.
<br />It is further considered and decreed by the court that all of said real estate belonging to
<br />said estate, extent the property and real estate devised to said Fred-A. Timpke, as hereinbefore
<br />described, did, under the provisions of the will of said deceased, pass at his death to the
<br />said Magdalena Timpke for her use and benefit during her life time, and that at her death same
<br />will pass in equal shares to the above named children, as in said will provided.
<br />It is further considered and decreed that the real estate devised to the said Fred A. Timpke
<br />as hereinbefore described passed to him on the death of said Henry E. Timpke, as by said will
<br />provided.
