<br />Daniel Ferguson, Deceased. )
<br />Now on this 7th day of September, 1909, this cause came on
<br />for hearing upon the report of William Ferguson, Executor of the Last Will and Testament, of
<br />Daniel Ferguson, deceased, and it appearing to the satisfaction of the court from the proof
<br />now on file, that all persons interested in said estate have bee -n notified of the filing of
<br />said report and have entered their voluntary appearance herein and waived further notice of
<br />the hearing thereon, admit the correctness of the account and ask the court to allow same, and
<br />it further appearing to the court, after a full examination that said report is correct in all
<br />respects and ought to be approved, and that all debts filed against said estate have been paid,
<br />it is, therefore, Ordered, Adjudged and Decreed that the report of William Ferguson, Executor be
<br />and the same is hereby approved and allowed. The Court finds that creditors of the said
<br />Daniel Ferguson were by order of court dated April 7, 1908, allowed six months from the 4th day
<br />of May, 1908, in which to present their claims against his estate in the office of the County
<br />Judge of Hall County, Nebraska; that the time then allowed for filing claims has fully expired;
<br />that due and legal notice was given all persons in the manner provided by law of the time
<br />allowed and place appointed for filing claims against said estate; that all claims and demands
<br />filed and allowed by the court have been paid and satisfied; that all claims outstanding against
<br />said estate, and not filed, if any there, be, are therefore barred and excluded. It is,
<br />therefore Ordered that all persons are forever barred from filing or setting up any claims or
<br />demands against said estate. The Court finds that the said Daniel Ferguson left surviving
<br />him as his heirs at law and his only heirs at law, devisees and legatees, the following named
<br />persons: Sarah E. Ferguson, his widow, and Phristina Ferguson McClung, his daughter, Daniel
<br />Ferguson, his son, and Grace L. Ferguson and Flora E. Ferguson, his daughters.
<br />The Court finds that the said Daniel Ferguson departed this life on the 22nd day of
<br />August, 1907, leaving a last will and testament which instrument was duly admitted to probate
<br />in this court on the 7th day of April, 1908, and which was in words and figures as follows:
<br />"Know all Men By These presents; That I, Daniel Ferguson, of Grand Island, Ball County,
<br />Nebraska, being of sound and disposing mind and memory, do make, publish and declare this to
<br />be my last will and testament.
<br />First: I desire that all my just debts and the expenses of my last sickness be paid out
<br />of my estate. Second: I give and bequeath to my beloved daughter Christina Ferguson McClung,
<br />the sum of one thousand 00 -100 Dollars.
<br />Third: I give, devise and bequeath unto my beloved wife, Sezah E.Ferguson, Lot Seven (7)
<br />in Block One Hundred Eighteen (118) in Railroad Addition to Grand Island, Hall County, Nebraska,;
<br />together with the dwelling thereon now occupied by us as a family residence, for the period
<br />of her natural life.
<br />Fourth: I desire that all the rest and residue of my estate, of whatsoever nature and
<br />wheresoever found, be turned over to my executor, hereinafter named, to be held by him during
<br />the lifetime of my said wife, and the rents, issues and profits thereof, to be turned over
<br />by him to my said wife, annually, or semi - annually, as the same may come into his hands, and
<br />giving and granting unto my said executor, in conjunction with my said wife and children, full
<br />power to sell and convey any vacant, non - producing real estate, such as vacant town lots or
<br />lands, the proceeds of such sale or sales to be safely invested by my executor in real estate
<br />mortgages, or other safe securities, and the interest accruing therefrom to be turned over by
<br />him to my said wife.
