� DEED OF TRUST 2 p 12 0110 � <br />Loan No: 101249434 (Continued) Page 6 <br />Lender as Trustor's attorney-in-fact for the purpose of making, executing, delivering, filing, recording, and doing ell <br />other th(ngs as may be necessary or des(rable, in Lender's sole op(nion, to eccomplish the matters referred to in <br />the preceding paragraph. <br />FULL PERFORMANCE. If Truator pays all the Indebtedness, including without limitation all future advances, when due, <br />and otherwise performs all the obligations imposed upon Truator under this Deed of Truat, Lender shall execute end <br />deliver to Trustee a request for full reconveyence and shell execute end deliver to Trustor auitable stetements of <br />termination of any financing statement on file evidencing Lender's security interest in the Rents and the Personel <br />Property. Any reconveyance fee requ(red by law shall be paid by Trustor, if permitted by applicable law. <br />EVENTS OF DEFAULT. Each of the following, at Lender's option, shall constitute an Event of Defeult under this Deed <br />of Trust: <br />Payment Defauk. Trustor fails to make eny peyment when due under the Indebtedness. <br />Other Defaults. Trustor fails to comply with or to perform eny other term, obligation, covenant or condition <br />contained in this Deed of Trust or in eny of the Releted Documents or to comply with or to perform any term, <br />obligation, covenant or condition contained in any other agreement between Lender and Trustor. <br />Compliance Defauk. Failure to comply with any other term, obligetion, covenent or condition contained in this <br />Deed of Trust, the Note or in any of the Related Documents. <br />Defeult on Other Payments. Failure of Truator within the time requ(red by this Deed of Trust to make any payment <br />for taxes or insurance, or any other payment necesaery to prevent filing of or to effect discharge of any lien. <br />Felse Statements. Any warranty, representation or statement made or furnished to Lender by Trustor or on <br />Trustor's behalf under this Deed of Truat or the Releted Documents is felse or misleading in eny meterial respect, <br />either now or et the time made or furniahed or becomea false or misleading at any time thereafter. <br />Defective Collateralization. This Deed of Truat or any of the Related Documents ceases to be in full force and <br />effect (including failure of any collaterel document to create a valid and perfected security interest or Iien) at any <br />time and for any reason. <br />Death or insolvency. The death of Trustor, the insolvency of Trustor, the eppointment of e receiver for any pert of <br />Trustor's property, eny assignment for the benefit of creditors, any type of creditor workout, or the <br />commencement of any proceeding under any bankruptcy or insolvency laws by or against Truator. <br />Credkor or Forfeiture Proceedings. Commencement of foreclosure or forfeiture proceedings, whether by judicial <br />proceeding, self-help, repossession or any other method, by any creditor of Truator or by any governmental egency <br />against eny property securing the Indebtedness. This includes a gernishment of any of Trustor's accounts, <br />including deposit eccounts, with Lender. However, this Event of Default shell not apply if there is e good faith <br />dispute by Trustor es to the validity or reasonableness of the claim which is the basis of the creditor or forfeiture <br />proceeding and if Trustor gives Lender written notice of the creditor or forfeiture proceeding and deposita with <br />Lender monies or a surety bond for the creditor or forfeiture proceeding, in an amount determined by Lender, in its <br />sole discretion, as being en adequate reserve or bond for the dispute. <br />Breach of Other Agreement. Any breach by Trustor under the terms of any other agreement between Trustor and <br />Lender that is not remedied within eny grece period provided therein, including without limitation eny agreement <br />concerning eny indebtedness or other obligetion of Trustor to Lender, whether existing now or later. <br />Events Affecting (ivarantor. Any of the preceding events occurs with respect to eny guarantor, endorser, surety, <br />or accommodation party of eny of the Indebtedness or eny guarentor, endorser, surety, or accommodation party <br />dies or becomes incompetent, or revokes or disputes the validity of, or liability under, any Guarenty of the <br />Indebtedness. <br />Adverse Change. A material adverse change occurs in Trustor's financial condltion, or Lender believes the <br />prospect of payment or pertormence of the Indebtednesa is impalred. <br />Insecurity. Lender in good feith believes itaelf insecure. <br />Existing Indebtedness. The payment of any instellment of principel or any interest on the Exiating Indebtedness is <br />not made within the time required by the promisaory note evidencing auch indebtedneas, or a defeult occurs under <br />the instrument securing such indebtedness and is not cured during any appliceble grace period in such inatrument, <br />or any suit or other action is commenced to foreclose eny existing lien on the Property. <br />Right to Cure. If eny default, other than a default in peyment is curable end if Trustor has not been given a notice <br />of a breach of the same prov(sion of this Deed of Truat within the preceding twelve (12) months, it may be cured if <br />Trustor, after Lender sends written notice to Trustor demanding cure of such default: (1) cures the default within <br />fifteen (16) days; or (2) (t the cure requirea more than Hfteen (15) days, immedietely initiates steps which Lender <br />deems in Lender's sole discretion to be aufficfent to cure the default and thereafter cont(nues and completes ell <br />reasonable and necessary steps sufficient to produce complience as soon as reasonably practicel. <br />RIQHTS AND REMEDIES ON DEFAULT. If an Event of Default occurs under this Deed of Trust, et any time thereafter, <br />Trustee or Lender may exercise any one or more of the following rights and remediea: <br />AcceleraUon Upon Default; Additionel Remedies.
