<br /> f ember 1%, 1947, Provided, tne Purchasers, and the survivor of tncrn,
<br /> pe-rsonally may temporarily make any use of the tract being sold
<br /> and purcizased which ��ill not pe.rmanently prevent compliance vvith
<br /> such Section V, "A" "Business District Regulations".
<br /> (2) The ground floor area of the main structure of any
<br /> dUVelling nouse, exclusive of open porches and garage, shall not
<br /> be less �:han One Thousand (1000 ' ) square fee�:.
<br /> (3) No building shall be constructed with unsigntly mat-
<br /> erials, boxes or salvage lumber; no building or dwelling house
<br /> shall be moved onto sucYi tract of land; no �railer, tent, garage,
<br /> shack or other unsigntly building, or out building, snall be
<br /> used upon such tract as a residence. ,
<br /> (4) No unsightly building materials, junl; or rubbish shall
<br /> be left exposed on such tract except during actual building
<br /> o erations.

<br /> (5) No foul vvaste vvater or ref use or garbage or se���age of
<br /> any kind siiall be permitted to be disposed of apon the top soil
<br />'�I of such tract. All sewage snall be conducted tnrough pipes or
<br /> wnolly enclosed drains i.o an adequate and efficient septic tank-
<br />��? or cizernical disposal receptacle tivhich shall not be closer tnan
<br /> tv�enty-five (25' ) feet to any lot line of the tract on which it
<br /> li' is installed.

<br /> I` (6) No ��vorn-out, discarded automobiles, machinery or parts
<br /> thereof, shall be stored on such tract and no part thereoz siiall
<br /> be used for discarded automobiles, machinery, junk piles, or other
<br /> storage of any kind of junk or waste, material, unless used for
<br /> "fill" and adequately covered by soil.
<br /> (7) The foregoing covenants, restrictions and conditions are
<br /> ;'
<br /> to run with such lands and snall be binding upon all persons and ;
<br /> all parties claiming ovvnership thereof until January 1, 1970. '�
<br /> IE (8) If any owner of any lo�t, or his, her or tr��eir 'rieirs or
<br /> assigns, shall violate or attempt �to violate any of the coven-
<br />� ants, restrictions or conditions nerein set fortn, it shall be
<br />� lativful for any otiler person or persons owning any real estate f
<br />�i in said tract to prosecute any proceedings at law or in equity
<br />�I against ttie person or persons violating or attempting to violate
<br /> any such covenants, restrictions or conditions, and to prevent ,
<br /> him rrom so doing or to recover damages for such violation,
<br /> Yrovided, that a breach of any such conditions, restrictions or
<br /> reservations shall not defeati or render invalid the lien of any
<br /> mortgage made in good faith for value as to any such lot, and,
<br />�� Provided, further, that such conditions, restrictions and re- �
<br /> servations shall remain at all times in full force and effecL
<br />� as against any owner of any lot for reason of any breach thereof
<br />�' by any such owner, whether acquired by purchase, foreclosure,
<br />'� devise, inheritance, or any other manner, and Provided, further
<br /> that should any one or more of any such conditions, -restrictions ;:
<br />� or reservations be declared invalid, by a courtof competent j:uris- �"
<br />� diction, the covenants, restrictions or conditions shall not be
<br /> affected, but shall continue in full force and effect. �
