<br /> WHEREAS, first parties are the awners of the North 14 feet of the Fast Half of Lot 11 and the North 14 feet
<br /> of Lot 12 all l.Il B1oek 20 of the Original Town of Wood River, Hall County, Nebraska, and
<br /> WHER�AS, second parties are the owners, under a contract f�r the purchase thereof as vendees, of the South
<br /> 13 feet of the North 27 feet �f the East Nalf of Lot 11 and. the South 13 feet of the north 27 feet of Lot
<br /> 12 all_ ir. i3lock 20 of the Ori.ginal Town of Wood Ricer, Hall County, Nebraska, and
<br /> LJfi�REAS, first parties contemplate building an extension to the west end of the present building naw on first
<br /> garties� premises descri_bed above anii first parties are desirous of utilizing the north wall of the building
<br /> naw si.tua.t�d on second partiests said premises,
<br /> NQW THEREF�RE, in consideration of $1 ,00 and other valuable considsratior paid to second parties by first
<br /> pa.rties, receipt whereof is hereby acknowledged by second parties, it is agreed by ahd between the parties
<br /> as fcllows:
<br /> 1. S�cond parties agree that fi_rst parties may utilize the wa11 running along the north side of the
<br /> building sitt�ated on second partiest said premises as and for the soiitbwall of the proposed extension of
<br /> first partiest buil_ding,
<br /> 2. Second parties agree that fi.rst parti.es may finish the surface of such part of said wall as would
<br /> be exposed in the interior of such prooased extension in such manner and with such materials as first parties
<br /> may, frem time to time deem to be suitable for theix purposes, fastening or affiacing such materials ?�o �aid'
<br /> wall`and a�.Cpring �r removing such materials as first parties may determine.
<br /> 3. Second parties agree that first parties may �oin the roof of such proposed building extensien �o
<br /> said wa].1 by such flashings and other buildin� materials and devices as will permit a weatherpranf union of
<br /> such raof xo or with said wall.
<br /> , 4. First parties agree that they wil.l not permit their use of said wal.l,either during construc�ion of
<br /> said extension or afterwards, to materially affect the structural soundness of said wall, and first parties
<br /> agree that they will not permit their use of said wall to adversely affect the normal use and enjoyment by
<br /> second parties of their said building in any manner other than may be inherently involved under the situation
<br /> herein contemplated wh9re a party wa11 exists between these two buildings, first parties building and the
<br /> extension thereto bein� utilized at present as a d.ental office and a dental laboratory. The continued use
<br /> by first parti?,s of said wall shall not cease, hawever, in the event first partiests building and the extension
<br /> thereto are utilized f or. other than dental office and d.ental laboratory purposes.
<br /> 5. FirsL pa,rties agree *hat they will be solely resnonsible for the repair and maintenance of tha.t
<br /> portion of the exterior surface of said wall as will be covered or Pnclosed by the proposed extension of
<br /> first partiest building.
<br /> 6. In the el�ent that said wall sh ou]_d be damaged or destroyed by fire, windstorm, floo� or other cat-
<br /> astrophe, second parties shall not be obligated to restore sai.d wall, bi�`, f irst parties, at their option
<br /> and at thei.r awn expense may rebuild said wall or repa.ir it so far as i:t extends to the west edge of first
<br /> parties proposed extension.
<br /> This party wall agreement shall be bindi.ng upon the parties, their assigns, personal representatives,
<br /> devisees and hei.rs at law.
