<br /> WHEREAS, the parties of the first part are the awners of The Southerly Fifty Feet (S50t ) of Lot
<br /> One (1) in Block Fotir (4), of Wiebe�s Addition to Grand Island, Nebraska and Arnold H. Kroger is the owner of the '

<br /> IT IS HFREBY yi[JTUALLY AGREED that the said Arnold H. Kroger, his heirs, assigns and all persons claiming
<br /> title by, through and under him, sl�all have an easement and right-of way across the Southerly Fifty Feet
<br /> (S50t) of Lot One (1) .in Block Four, of Wiebets Addition to Grand Island for the purpose of maintain3,ng
<br /> tl� sewer that is ncna presently located thereon with the exception, hawever, that in the event said sewer
<br /> runs underneath the house now located on said Saztherly Fifty Feet (SSd�) of said Lot and at some future time
<br /> it may be necessary to repair the same, no repairs shall be permitted underneath said house; and �

<br /> IT IS FURTHE.R AGREED that should it be necessary the sewer may be re-located across said Southerly
<br /> Fifty Feet (550�) of said Lot One (1) at a place to be mutually agreed upon between the parties hereto, '
<br /> and any ami all damage or replacements that may be necessar,y by reason of maintaining said sewer hereinbefore
<br /> referred to, � , �liall be paid �or by the said Arnold H. Kroger or persons claiming title by, through
<br /> or under him.

<br /> This agreement is bind�upon the heirs, assigns and grantees of the parties herein and shall operate
<br /> as an easement running with the land to the extent hereinbefore referred to.
