<br /> Now on th is 6th day of October, 1950, this matter came on for hearing, the plaintiff being present in
<br /> person` and by her attorney Paul C. Holmberg, The defendant was not preaent and it appearing to the court that
<br /> the defendant was duly served with a summons in this matter and having failed to answer, demur or otherwise
<br /> plead, and having failed to appear, the default of said defendant is hereby entered and the allegations in
<br /> Plaintiff�s Petition are taken as true against said defendant.
<br /> This matter than came on to be heard and was submitted to the court upon the evidence and the pleadings
<br /> and the court being fully advised in the premises finds that the plaintiff and the defendant are wife and
<br /> husband; that they were married on the 28th day of September, 1949, at St. Paul, Howard County, Nebraska
<br /> and that no children have been born to this union.
<br /> That the defendant herein has been guilty of extreme cruelty ton�ards the plaintiff; that the defendant
<br /> frequently uses liquor to excess and that wh ile under the influence of intaxicating liquor, said defendant
<br /> is quar�elsome and has at various times struck the plaintiff and has without provocation threatened to do
<br /> plaintiff great bodily injury, az�d that by reasons of such acts of cruelty, plaintiff is entitled to an
<br /> absolute divorce.
<br /> The court further finds that the plaintiff and defendant herein were heretofore married, to-wit: 16th
<br /> day of May, 1944 an3 that plaintiff in this action secured a divorce from the defendant herein in the District
<br /> Court of Hall County, Nebraska, on the 4th day of June, 1948; that at the divorce hearing held on said date
<br /> this court found and determined that plaintiff was the awner of the real estate described as Lot Eight (S),
<br /> Block Twelve (12), Evans Addition to the �ity of Grand Island, Nebraska and by the decree of this court
<br /> ti�le to said real estate was quieted in the pla.intiff in this action; that after the plaintiff was divorced
<br /> from the defendant they were a.gain married as stated in plaintiffts petition filed in this action, to wit:
<br /> September 2A, 1949; that the plaintiff herein is still the owner of said real estate described as. Lot
<br /> Eight (S), Block 'It,�elve (12), Evans Addition ta the �ity of Grand Island, Nebraska and that if said defendant
<br /> has or claims any interest in and to sai.d described real estate that said defendant be and he is hereby forever
<br /> barred from claiming or asserting any right, title or other interest in and to said property and that title
<br /> to said real estate be and the same is hereby quieted in the plaintiff herein, Clara V. Barnum.
<br /> The court further finds that all items of househald goods or personal property used by the �a rties herei�
<br /> have been purchased by and belong to the plaintiff; that all items of household goods are therefore given
<br /> and awarded to said plaintiff.
