<br /> guardian ad li�em heretofore appointed by this Court herein, being present in person,
<br /> upon the petition of plaint3.ff and the answer of William G. Bl�.ckburn, guardian ad litem
<br /> f or the defendants Fred H. Klunge, Theodore R1uge and Ronald Kluge, minors, and from an
<br /> examinat�on of �he filea the Cour� finds �hat �he defendants Helen V. Kluge and Helen V.
<br /> Kluge, Admini�tratrix of the Estate of Vernon D. Kluge, deceased, have failed to file any
<br /> pleadings wha�soever herein, and f rom the testimony adduced in euppor� oP plaintiPf� s
<br /> petition and the testimony of the defendants Helen V. K1uge and Helen V. Kluge, Ad.ministr�.��ix
<br /> of the Eatate of Vernon D. Klu��, deceased, the Court f inds generally in favor of �laintiff
<br /> ,and against said def endants and all of them, and find5 �he allega�3ons csg plaintifz"� s

<br /> The Court further finds that '�he warranty deed recorded in Book 91 of Deeds, Page 511 _
<br /> in the Ofi'ice of the Register of Deeds of Ha11 County, Nebraska, in truth and in fact
<br /> conveyed unto Vernon D. Rluge
<br /> The Northerly �0 feet of Lo� Five (5) in B1ock
<br /> Seventy-five (75) in the Original Town, now City
<br /> of Gr�,nd Island, in Hall Cour�ty, Nebraska,
<br /> as Trustee, and �hat said Vernon D. K1uge held �itle to said premises in �ruth and in fac�
<br /> only as Tru�tee for Anna Kluge from and af�er the filing and recording of said deed up to
<br /> `the date of the death of said Vernon D. Kluge which occured on May 12, 1951; tha.t said
<br /> Anna Kluge was in truth and in fact the sole owner of s�.id real eetate during said period
<br /> ;of time and was in truth and in fac� the sole owner thereof on September 2, 1951, the date
<br /> �of her dea.th, and that said Vernon D. Kluge, at the time of his said death on May 12, 1951,
<br /> had no right, titl� or 3.nterest in and to said premises or any part �hereof wha�Gsoever;
<br /> The Court fur'�her f3.nds that said Vernon D. Kluge at the time of his death held the
<br /> naked 1e�a1 title to said premises as Trustee for said Anna Kluge and �hat the defendants
<br /> Helen V. Kluge, Fred H. Kluge, Theodore Klu�e, Ronald K1uge, and Helen V. Kluge,
<br /> Administratrix of the Eatat� of Vernon D. K1uge, deceas�d, have no �right, title or interest
<br /> in and to said �remises or any par� thereof as a resul� of the death of aaid Vernon D. Kluge,
<br /> and that rncsn� �f the creditors of said Vernon D. K1u�e, excepting only The �qui'Gable
<br /> 'Building & Loan Association of Grand Island, Nebraska, by virtue of the mortgageg recorded
<br /> `in Book 87 at P�,ge 490 and Page 557, h�:ve no 3.nterest whatsoev�r in �,nd to said real estate
<br /> nor are the costs of administration of the Estate of said Vernon D. Kluge, deceased, a
<br /> lien wha�soever on said real estate and every part thereof, and �hat title and ownership
<br /> "of the said real estate passed by virtue of t�l� terms and provisions of the Last Will and
<br /> :Testament of Anna Kluge, deceased, whieh Will was admitted to probate by the Coun�y Court
<br /> of Ha11 Coun�y, Nebraska, on October 3, i95i, to Wilma Vodehnal as Executrix of the
<br /> Estate of Anna Kluge, deceased, with full power �o sell said real estate at publie sale
<br /> in such manner as she may deem for the best interests of the Estate of said Anna Kluge,
<br /> deceased, f or the purposes set for�h in said Las� Will and Testament;
<br /> IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT tha� �he �itle to
<br /> the Northerly 60 fee'G of Lo� Five (5 ) in B1ock Sev�nty-five (75 )
<br /> in the Original Town, now City of arand Ssland, in Hall Coun�y,
<br /> Nebraska,
<br /> be and the s�,me is hereby quieted in Wilma Vodehnal, Executrix under the Last Will and
<br /> 'Testament of Anna Kluge, deceas�d, as against the d�fendants and each and all of them so
<br /> far as any righ�s th�y or any of �hem acquired by virtue of the death oP Vernon D. Kluge,
<br /> deceased, and tha� non� of the crec�itora of said Vernon D. Kluge have any interegt wha�-
<br /> soever in and to said real estate, excepting only The Equitable Building & Loan Association
<br /> ;of Grand Tsland, Nebraska, by virtue oP the mortgages recorded in Book 87 at Page 49Q and
<br /> Page 5�7 of the Mortgage Records in the office of the Reg3.ster of Deeds of Hall County,
<br /> Nebraska, and tha� the cost of administration of the Estate of Vernon D. Kluge, decea�ed,
<br /> ;constitute no lien whatsoever on said real estate or any par� thereof; the costs of theae
