<br />. _ a son of Mary Klinkacek and th� brother of Louis Klinkacek, who on May 15, 1923

<br /> Southeast quarter of section 8 township 11 Range 12, West of 6th P. M. Hall County, Nebra�ca
<br /> which agreement was recorded in Liook r,Or' of Miscellaneous Fiecords at page 268, of the deed records of Hall
<br /> county N�braska., in which agreement sa.id Louis Klinkacek agreed to pay to Mary Klinkacek one third of all
<br /> crops raised on said land, each year during the natural life of said rfary Klinkacek, and in. event of the
<br /> failure of such paynnent and del.ivery of rent, the certain warranty deed of said Mary Klinkacek dated the
<br /> 28th day of March 1923 whereby said land was conveyed to said Louis Klinkacek, and recorded in Book 63 of
<br /> Deeds at page 372 of said Hall County deed records, would be "null and void't, and said Mary Klinkacek or her
<br /> heirs at law, to have the right of re-entry and possession and said deed treated as a lease.
<br /> Your affiant shows further that his said mo�her was living with your affiant at the time the above
<br /> described deed and agreement was made, and had lived with him for many years prior thereto and lived with
<br /> him �he rest of her life. That she, hi.s said mother died in the year 1930
<br /> That said affaint helped his mother ir. all of her fianancial affairs, and helped her in collecting
<br /> rer.ts mentioned in the agreement a.bove described. That he knows positively that all rents described in said
<br />' agreement, and any and all other covenants and a.greements in said contract contained, were paid and delivered
<br /> and discharged in full by sa.id Louis Klinkacek, to his said mother, and that his said mother never had any
<br /> rea.son to clecla.re a forfieture of said contract an.d agreemer.t, or the deed, referred to in said agreement, and
<br /> no such f orfieture was ever declared or had or attempted to be done by his said mother, during her life
<br /> r,ime. That the deed above referred to is absolute.
<br /> That a.11_ of her funeral expenses and expenses of her last i.11ness were paid in full by your affiant out
<br /> of money belonging to his mother, after her death. That the estate of Mary Klinkacek was duly probated in
<br /> the County f;ourt of �uffalo County l�'ebraska, and your a.ffiant was the administrator of said estate, and no
<br /> claim was ever made by him or any of the heirs at law or devisees or legattes of �hEir said mother, '�iary
<br /> Klinkacek, against sa.id Louis Klinkacek for any rPnts er claim of� rents as aforesaid, since there was no
<br /> such rent due to said estate from him.
