<br /> THIS �GRFENIENT made and entered into this 31st day of October, 1951, by and between EMIL F. ROESER
<br /> and FRTEDA H. ROFSE:ft, his wife, and OSCAR F. ROFSER and ELLA ROESER, his wife, of Grand Island, Nebraska,
<br /> parties of the first part, and S. 11'. WOLI3ACFi SONS, II�C. of Grand Island, Nebraska, party of the second part, ,
<br /> as a supplement to the party wall lease recorded in Book D, Page 469, and the agreement recorded in Book G,
<br /> Page 273, in the off ice of the Register of Deeds of Hall County, Nebraska. �
<br /> Parties of the first part are now the owners in fee of the Westerly Tt✓o-Thirds (W 2�3) of Lot Three
<br /> (3) in Block Sixty-Siac (66), and party of the second part is now the owner of the Easterly One-Third
<br /> (F 1/3) of said Lot Three (3), in �lock Si�ety-six (66), Original 'Cown, Ajow City:-.of Grand Island, Hall
<br /> ,�County, Nebraska, on which from tirne to time structur�s of varying depth and height have been erected
<br /> or extended and the wall between the structures as they now exist in��ude a party wall erected on th�
<br /> dividing line �n accordance with and in conf ormity to provisions of the ag�eements hereinabove referre�

<br /> WfiEREAS, the ownere of the ��desterly Two-Thirds (W 2�3) of said Lot Three (3) now have a baildi�� with
<br /> the easterly wall extending to within two feet of the alley line, one-story in height, with ''a second �torp
<br /> wall extending a short distance beyond the second floor of the building on the Fasterly One-Third (F 1�3)
<br /> of said Lot Three (3) and party of the second part is now desirous of extending its building on the said
<br /> Easterly One-Third (E 1/3 of Lot Three (3) to the alley and in connection therewith using such wall as now
<br /> stands on the line constructed by parties of the first part, or their predecessors in title; now
<br /> THEREFORF, it is further agreec� by gnd between the parties hereto that for and in eonsideration of the
<br /> sum of Six Hundred and ATo/100 Doll.ars (�600.OQ) in hand paid fo the parties of the first part;'.�bp party of th�
<br /> second part, receipt whereof is hereby a.cknowledged, the parties of the first part do hereby convey to the
<br /> party of the second part an undivided one-half inter�st in such portion of the easterly wall of their building
<br /> as will be required by party of the secon d part as a party wall in connection with such proposed addition attd
<br /> party of the secon d part is given the right to incorporate and use said wall in the construction of the
<br /> addition to the building on said Easterly One-Third (E 1�3) of said Lot Three (3).
<br /> �aHFIdEAS, it is contemplated by second party that the addition to its structure will be extended two
<br /> full stories in height to the alley, second party ag.rees that th� additional wall required in connection
<br /> th�rewith on the party line will be constructed substantially in conf ormity with the specifications set forth
<br /> in the agreement recorded in Book D, Page 469, and the agreement recorded in Book G, Page 273, and reqairements
<br /> of the Building Code of the Citp of Grand Island, to permit the use thereof at any time in the futur� by
<br /> parties of the first part, or their successors in title, as a party wall, it being further agreed in the
<br /> event parties of the first part, or their successors in title, extend their building to use the wall being
<br /> construet�d by second party or any part thereof at any time in. the fu�ur� and during the eontinuance of these
<br /> agreemen.ts th�y sha.11 pay to party of the second part, its successors or assigns, on�-half of the value of
<br /> such new wall constructed based on an appraisal rnade at that time by three competent appraisers, one to be
<br /> selected by each of the owners of said property involved, these two to select the third.
<br /> 7n all other respects the provisions of previous agreements shall continue to apply insofar as the
<br /> contegt th�reof is applicable.
