<br /> ORDINANCE N0. 2533 ^ CONDEMNING PROPERTY FOR ALLEY IN PARKHILL SUBD NISION.
<br /> An Ordinance appropriating and condemning private property in the City of Grand Island, Nebraska, for
<br /> the use of said City �or the purpose of constructing thereon and extending an alley; providing for the levp
<br /> and assessment of thc amount of damages and costs incurred in such condemnation and providing for the
<br /> collection thereof.
<br /> Wf�REAS, the Council af the City of Grand Island, Nebraska, finds that it is necessarp that private
<br /> property within the bounds hereinafter rnore def�initely described, all within said City, be appropriated and
<br /> conder�ned for the purpose of constructing thereon and extending an:^allep.
<br /> N�d, THEREFORE, BE TT ORDAINED BY THE COUNCIL of the City of Grand Island, Nebraska;
<br /> SECTION`.1. That the follawing described real pnoperty, consisting of a strip of land as hereinafter
<br /> designated, be, and the same is hereby appropriated for the use of the City of Grand Island, Nebraska, for
<br /> the purpose of constructing thereon and extending an alley, under and by virtue of Sections 16-601, 16-602,
<br /> and 16-603 of thc compiled statutes of the State of Nebraska for the year 1943, and Section Nine �:9} Artie�e
<br /> Two (2) of the Home Rule Charter of the City of Grand Island, Nebraska.
<br /> SECTION 2. The land so appropriated and condemned for such alley pttrposes is described a� f ollows:
<br /> A tract of land f or alley purposes in Block 7, Ashton Place, a.n addition to the City of Grand Island,
<br /> Ncbraska, more particularly described as follaws: Beginning at a point 132 feet southerly and 3.5
<br /> feet easterly from the northeasterly corner of Lot 4, Block 7, Ashton Place, as surveyed, platted
<br /> and recorded; said point of beginning being at the southresterly corner of fractional Lot 3�, Block
<br /> 48, Wasrnerts 3rd Add�tion; runni�g thence westerly on a line 132 feet from and parallel to the
<br /> �ortherlp lines �i e°tt'P�r2���}4, � �c�'�n 6, Block ?, Ashton Place, a distance bf 128.? feet to the east
<br /> and west quarter section,�2�; ��ans�iip 11, North rangc 9, West of the 6th P. M. ; running thence east
<br /> on said quarter section line a di�tance of 31.8 feet; running thence easterly on a line 148 feet
<br /> from and parallel to the northerly lot lines of Lots 3, 4, 5 and 6, Block ?, Ashton Place, a distance
<br /> of 93 feet to the northwe�terly corner of fractional Lot 7, Block 48, Wasmerts 3rd Addition;
<br /> running thence northerly 18 feet to the place of beginning; said .tract being a st.»ip of land 16 feet wide
<br /> through fractional Lots 3, 4; 5 and 6, Block 7, A�$ton Place, connecting t�e platted alley in Block
<br /> 48, Wasmer�s 3rd Addition with the platted alle�* in Block 3, Parkhill Subdivi�ion, containing 0.041 acres
<br /> more or less. . :
<br /> �ECTION 3. That the Pollowing disinterested f'reeholders in the City of Grand Island, Nebraska, are
<br /> hereby appointed to assess the da.�nages accruing to the aaner or owners of the real estate and rights
<br /> appropriated:
<br /> H. T. Brawn 916 South Locust Street
<br /> Fred Ma,urer 2017 West Koenig Street
<br /> Clayton B. Pollard 2619 West Koenig Street
<br /> all in the Citp of Grand Island, Nebraska, and who shall receivc as compensation for their services the sum
<br /> of Five Dollars ($5.00) per day for the time necessarilp occupied in assessing �aid dam�ges. Said assessors
<br /> shall meet in the Council Chamber of the Citp Hall in said City of Grand Island, on the 25th day of October,
<br /> 1951, at the hour of 2 o�clock P.M. ; and after taking oath to disCharge their duties faithfullp and impar-
<br /> tially shall on the same day, or aa �oon thereafter as practical, make, sign and return to the �;City Clerk
<br /> in writing a just and fair appraisement of the damagcs for the lot or piece of propertp, the whole or part
<br /> of which or rights in which are to be appropriated.
<br /> � �
<br /> SECTION 4. Payment of the damages for the appropriation of said private property shall be paid out of
<br /> the Gencral Fund of aaid City.
<br /> SECTION 5. The Citp .+Council shall asse�s and levy the whole or part of the expenses and damages
<br /> incurred in the taking of said real estate as above described upon the property fronting upon the �ame and
<br /> upon the property near by that may be benefited in proportions according to the benefits as provided by law. ;
<br /> SECTION 6. This ordinance shall be in force and take effect from and after its pasaage, approval and
<br /> publication as providcd by law.
<br /> Passed and approvcd bp a majority vote of all the members of th.e City Couacil, this the 24th day of
<br /> September, 1951.
