<br /> THIS AGREEMENT entered into this lOth day of September, 1951, hy and between William Goldberg and rlargaret L.
<br /> Goldberg, spouse of each other, first parties, and Fdmuncl P. Sondergaard and Lillian D. Sondergaard, spouse
<br /> of each other, second parti.es.
<br /> WITI��ESSETH: That whereas first parties are successors in title of Harold [t. McKnight and Gladys M. McKnight,
<br /> and second parti.es are successors in title of Walter Wolford and I3essie L. Wolford, �.nd
<br /> WHEREAS the said t�1�,rold R. ATcKnight and Gladys M. McKnight entered into an agreement for an easement with
<br /> the said Walter Wolford and ?�essie L. Wolford, which agreement for easement is recorded in Book ttUrf of
<br /> Miscellaneous Records at Pag� 415 in the office of the Register of Deeds of Hall County, rebraska; and
<br /> whereas the parties to this agreement are desirous of clarifying and terminating said original �asement
<br /> agreement and entering into a new easement agreement,
<br /> NOW THEREF0�3F, it is agreed by and k�etween the parties hereto that the easement agreement referred to above
<br /> and recorded in i�ook t�tP� of Miscellaneous P.ecords at Page 415 in the records of the Register of Deeds of
<br /> Hall County, I��ebra�k�,, be a.nd the same is hereby terminated.
<br /> That the property herein affected is described as f ollows:
<br /> Part of the I�orthwest Quarter of Section 22, in Town.ship 11, l�orth, Range 9, West of the 6th P.r1.,
<br /> being a rectangular piece of ground 108 feet wide by 449 feet long, situated immediately north of
<br /> Lots l, 2h and 27 of Hawthorne Place, being the tract described in d�ed recorded in Book 48 at
<br /> P�ge 136 of th� deed ��a�d� of Hall County, l�ebraska, said Hawthorne Place being a Subdivision of
<br /> pa.rt of the Northwest Quarter of Section 22, Township 11, North, Range 9, West of the 6th. P.M, and
<br /> heing more 'particularly descrihed as follaws, to wit: Commencing at the 11Torthwest corner of said
<br /> rectar.�gular tract, thence south on the west line of said tract a dist�.nee of 108 feet, thence east
<br /> on the south li.ne of said tract a d.istance of 89 feet, thence north 108 feet, thence west, and pa.rallel
<br /> with the south line of said tract and along the north line of said tract a distance of 89 feet to
<br /> the place of beginning, being a rectangular tract of ground having a westerly frontage of 108 feet
<br /> on South Pine Street and a dept}i of 89 feet, in I�all County, Nebraska.
<br /> Tha.t first parties a,re the owners of the south half of said tract, and that second pa.rties �re the owners of
<br /> the north half of sa,id tract;
<br /> That there is a garage located on said tract, a part of which �xtends south of the dividing line and thus
<br /> rests on a pa.rt of first parties half of said tract.
<br /> IT IS FU�tTFi�R AGREED by and between the parties hereto that second parties grant and give to f irst parties,
<br /> their successors a.nd assigns, an easement over the south �ight feet (Sf) of the north half of said tract,
<br /> th� sam� being the south eight feet (8T) of the north half of said tract imm�diately north of the dividing
<br /> line between the north and south halves of said tract and second parties further grant and give unto first
<br /> parties, their successors and assigns, the right to use the south half of the two car garage presently
<br /> loc�ted on the a.bove described premises.
<br /> IT IS F't1RTHF,�Z AGREED that secon.d. p�.rties shall have the right to remove sa�id gara.ge to the north half of
<br /> said tract upon payment to first parties of the sum of $150.00 �.nd until such time as such payment is made,
<br /> first pa.rties sha.11 not be requir�d to pay any rent for the easement herein gra,nted. This easement shall
<br /> terminate upon the payment by s�cond parties to first party of said sum of $150.00 and the removal by second
<br /> parties of said gar�ge from the south half of said tract.
<br /> IT IS FURT�IER AGRFFD that the granting of this easement shall give first parties no cla.im or interest in —2—
<br /> said cight foot tract other under the terms of this easement and said eight foot tract shall bc used as a
<br /> driveway leading to and from said garage.
<br />'' " IT IS FURTHE�Z ACTREFD that this easement and the conditions thereof shall be binding upon and inure to the
<br /> benefit of the heirs, devisees, successors, and assigns of the parties hereto.
<br /> IT IS FURTHF.R AGREED that when said gar�,ge is removed from the south half of said tract, that a Certificate
<br /> of Removal ex�cuted by the City Engineer of the City of Grand Island, l�ebraska, will be sufficient evidence
<br /> �b termin�.te this easement, provided, also, that proof of payment of said $150.00 payment is also shown.
<br /> IT ZS FUR'IHER ML'TtTALLY AGREFD that the parties hereto shall have the joint use of said eight foot strip
<br /> � aovered by this easement and the parties hereto mutually agree not to unreasonably interfere with each
<br /> others use thereof so that the same ma.y be used by them jointly as a driveway until this easement is
