For and in considera.tion of the sum of One ($1.00) Dollar, this day in hand paid by said party of <br /> , the Second Part to each of the parties of the First Part, the receipt whereof is hereby confessed and <br /> acknawledged, and of the covenants on the part of said party of the Second Part hereinafter contained, said <br /> parties of the First Part hereby grant to said party of the Second Part the rights and liberties following, <br /> namely,-- <br /> (a) For the purpose of carrying away, disposal of, and conveying sanitary sewage, the parties of the <br /> First Part hereby grant and convey unto the party of the Second Part the right to enter upon the within <br /> descrihed lands and to do all things necessary in the laying and constructing of a s�,nitary sewer main on <br /> the South twelve {12) feet of the lots situated in the North one-half (n2) of said Block �►elve (12) and <br /> over, along and across the lots in said Block 'I�aelve (12), Boggs and Hill Addition, hereinbef ore described. <br /> That said sewer main or line may be of such size and capacity and be laid at a depth which the party of the <br /> Second Part may deem necessary for the successful operation of said sewer. The party of the Second Part by <br /> these presents is hereby authorized to make all excavations necessary in the construction of said sewer and <br /> to lay and inst�ll said sewer main with all necessary accessories and connections therefore and to backfill <br /> said excavations and restore the surface thereof as soon as possible. <br /> (b) The parties of the First Part further grant unto the party of the :Second Part the right to construct <br /> , all necessary manholes and other accessories necessary in the construction, ma.intenance and operation of <br /> said sewer which the party of the second part may deem proper and necessary. <br /> (c) The partie.s of the First Part hereby agree that should any of his or their barns, garages, coal -3- <br /> houses, or any other out building be so situated so as to be on a line where said sewer is to be constructed <br /> that such barn, garage, coal house or other out building shall be moved so as not to be in the road of or <br /> interfere with the construction, maintenance, operation or repair of said sewer, and the cost of moving of <br /> any of said out buildings shall be born and paid f or by the party of the first part awning the same; and <br /> no claim shall be made against the party of the Second Part f or any damages or damages caused to said <br /> buildings in the moving thereof. <br /> (d) The second party shall have the right, from time to time, to enter upon said premises and to open <br /> up said sewer line or main, or any part thereof, f or the purpose of inspecting, repairing, or renewing the <br /> same as occasion may require, doing no unnecessary damage to said premises and restoring the surface <br /> thereof whenever opened up, as soon as may be possible. <br /> The parties of the First Part hereby grant unto the party of the Second Part the rights and privileges <br /> herein s�t forth forever. <br /> (3) It is mutually understood and agreed by and between the parties hereto that there are various lots, <br /> tracts and parcels of land in Block Ttaelve (12), Boggs and Hill Addition to the City of Grand Island, Hall <br /> County, Nebraska, which are not described and set forth herein. That said lots, tracts, and parcels of <br /> land are to be served and connected with said sewer line or main. That sewers serving said lands in said <br /> Block which are not described herein may be connected with the sewer main to be installed upon the lands <br /> of the parties of the First Part. That al1 necessary excavations therefore, are hereby authorized and <br /> granted without limitati.on. as to time or plac.e and any and all accessories necessary in making such <br /> � <br /> connections are hereby authorized. <br /> B <br /> � 4. Said party of the Second Part covenants with said parties of the First Part as follvws: namel <br /> Y,-- <br /> that <br /> (a) Said party of the second part will do all the work and things hereby authorized to be done by it <br /> -4- <br /> upon or affecting said premises, in a good and workmanlike manner, and so as to cause no unnecessary damage <br /> or distu�rbance to said premises. <br /> 5. Said parties of the First Part covenants with said party of the Second Part that said party of the <br /> Second Part performing and observing the covenants and conditions on its part to be performed and observed <br /> may peaceablg hold and enjoy the rights and liberties hereby granted without any interruption on the part <br /> of the sa.id parties of the First Part, <br /> 6.
