Danitz, each in his or her awn right and as spouse of the other, of Ha11 <br /> County, Nebraska, having hereto f ore made application to Nebraska Loan Ffi Trust Company, Grand Island, Nebraska, <br /> for a loan on the premises described below,: and in consideration. of the said Trust Company ma.king said loan <br /> and for other good and valuable consideration, receipt whereof is hereby acknowledged, do hereby assign and <br /> transfer to said 1�Tebraska Loan f-� Trust Company as addition�l security for said loan all of the rents, income <br /> and profits arising out of the premises described as follo�ws, to wit: <br /> � <br /> All that part of the Fast �Ialf of I�Torthwest Quarter (E2NW4), lying north of the right-of way of the <br /> Union Pacific Railroad Company of Section 34, i.n Township 11, Range��10, West of the 6th P. M. and <br /> containing 22 acres more or less, but excepting a strip of land deeded to the State of Nebraska as <br /> described in Deed recorded in Book 82, Page 508 of the Deed Records of Hall County, Nebraska. <br /> This assignment of rents is made for the express purpose of having the income from the said premises appTied <br /> to the repayment of the above described loan and interest thereon, delinquent taxes, and insurance premiums <br /> which may be charged against the above premises. Said company may, at its descretion, use said rents for the <br /> payment of said loan or the accrued interest thereon or delinquent taxes of payment of insurance premiums as <br /> it may deem best, <br /> We hereby authorize and empower the Nebraska Loan � Trust Company, its officers, agents or attor-neys to act <br /> for u.s in the collection of the rent and to agree upon the prices of the rental to be paid, and look after <br /> the renting of said premises. <br /> IT IS FURTHER AGREFD, that if the undersigned assignor or his or their successors, occupy said premises during <br /> the existance of said loan, the assignee shall have the same rights of forfeiture, ejectment and f orcible entry <br /> � and detainer and such other actions as it would have against any tenant occupying said premises and having no <br /> � interest therein. The Trust Company may have the right to waive any collection of any part of said rent and <br /> � <br /> if it does so, it shall not be construed as constitutit�g a relinquishment of any of the rights given under <br /> this assignment, but said rights may be exercised at any ti.me said Trust Company deems it advisable to do so <br /> � and said right shall continue so long as the mortgage or interest or any part thereof:rema,ins a lien against <br /> � said premises. <br /> IT IS FURTHFR AGRF.rD, that the said Trust Company shall not be liable for the loss of the collection of any <br /> � rents and said Company is only required to use reasonable diligence in collecting said rents. The Trust <br /> Company sk�ail have the right �o deduct from said rents a fair and reasonable compensation such as expense, <br /> court costs, and collecti.on costs, which are incurred, the balance shall be app�ied to the payment of the <br /> balance due on the loan or interest., or taxes, or insurance premiums in the manner in which said Trust <br /> Company shall deem best. <br /> This assignment shall be irrevocable and shall remain in force until the above described loan and interest, <br /> ,� delinquent taxe�s and insurance premiums thereon shall be paid arad until said mortgage is satisfied in full <br /> and release�l. <br /> Dated this 29 day of May 1951. <br /> A.
