<br /> WHF�FAS, the Hunnells are the owners of the
<br /> Torth Half (r:2) of Lots Fifteen (15) and Si�cteen (16), in Block Seven (7), Boggs and
<br /> � Fiill�s Addi.tion to the City of Grand Island, Hall County, Nebraska; and,
<br /> WHEREAS, it is desired by the Hunnells that pipes for gas and war,er to the said North Half of said
<br /> Lots should pass across and under the property belongi:ng to the Schwartz: and,
<br /> ��EiFIZEAS, i�t is desired that overhead wires for telephone and electrics�:y should pass across and over
<br /> property of the Hunnells to the property of the Schwartz;
<br /> NOW THFREFORE, i.n considerati_on of the mutual promises and covenants of the parties hereto, it is
<br /> . agreed as f ollows:
<br /> l. The Schwartz hereby grant to the Hunnells, a right of way easement �mder and across said Sotxth
<br /> Half of Lots 15 and 16 for the constr�iction, operation and mainter.ance of gas and water pipes for the
<br /> benefit of said north Half of Lots 15 and 16.
<br /> 2. The Hunnel]>s hereby grant to the Schwartz, a right of way easement over and across said north
<br /> F�alf of Lotsc�l5 and 16 for t�e construction, operation and maintenance of telephone, electrici.ty and
<br /> other overhead wires for the benefit of said South Half of Lots 15 and 16.
<br /> 3. Each of the parties hereto grants to the other the right of ingress and egress to and from their
<br /> respective lands to that of the others for the purpose of constructing, operating and maintaining said
<br /> pipes, wires or lines; provided, however, each of the parties shall be liable to the others for all
<br /> actual damages to the others property in constructing, operating or maintaining such wires, pipes and
<br /> lines.
<br /> 4. The pipes, wires and lines above referred to shall be constructed and maintained in such a manner
<br /> as to cause a minim�zm of dama.ge, or inconvenience, or 3isruption in the use of, the respective premises.
<br /> 5. These mutual right of way easements shall continue unti.l terminated by the mutual agreement of
<br /> the respective owners of these properties at the time of such termination. These easements shall accrue
<br /> to the benefit of the parti.es hereto and their hei.rs, executors, administrators and assigns.
