<br /> provement and pavi.ng thereof, and I am fami3:iar. in a general way with the streets in the City of Grand
<br /> Island and particu.larly familiar with, and know. of my own knowledge, the streets abutting upon and adjacent
<br /> to Block Forty-four (44) in tJasmerfs Second Addition to the City of Grand Island, Hall County, �i':ebraska.
<br /> 7 further depose and say that while there was a trail across the South Half of said Block; that
<br /> said trail was not and never has been recognized by the City of Grand Island as a street or alley; that
<br /> the City of Grand Island never at any time claimed any right to the same, but that the use of the same by
<br /> certain. partxes who desire r.o use the same was purely permissive on the part of the owners and not by
<br /> virtue of any claimec� right on the part of any person to use the same; that the City of C,rand Island has
<br /> paved ldest Anna Street on the So�zth side of said F31ock and Harrison Street on the Fast side of said �31ock
<br /> and the trail r,har, ran across the Southeast corner of said t3lock has Ueen abandoned and is no longer used
<br /> by any person or persons whomsoever.
<br /> - I further depose and say that I know of no person who has ever asserted any right to use said trail
<br /> as a matter of right, but that the use of said r,rail was permissive only until such time as the City might :?
<br /> improve the streets adiacent to said !�lock.
<br /> I further depose and say that the City of Grand Island claims no right whatsoever to said trail.
