<br /> Crand Island, Hall County, Nebraska and has been for more than twenty-five years last past; that he is
<br /> well and personally acquainted with Paul M. Kane and Maxine K. Kane, Grantees in the Sheriff�s Deed
<br />� recorded in 13ook 89, Page 390 of the Deed of Records of Hall County, Nebraska, and with Paul W. Kane and
<br /> Maxine R. Kane, Grantors in Warranty Deed recorded in Book 98, Page 526, of the Deed Records of Hall
<br /> County, Nebraska, and that affiant knows of his own personal knowledge that the said Paul M. Kane and
<br /> Maxine K, Kane and Paul W. Kane and Maxine R. Kane are one and the same persons shown in Sheriff�s Deed
<br /> and Warranty Deed as herein set forth, norwithstanding the discrepancq in names.

<br /> No�v en this 7th da,y of july 1949 came the plaintiff in person and by his attorney, Lloyd W.
<br /> KeI2.y, and the defendant still failing to answer or otherwise plead to plaintiff�s petition, but made
<br /> default, and it appearing to the court that the defendant had been duly notified of the f iling of and
<br /> pendency of the suit by having entered her voluntary appearance in said matter, it is ordered that the
<br /> default be entered herein, and that the facts stated in plaintiffts petition be taken as true against
<br /> said defendant.
<br /> The Court further finds that the plaintiff at the time of filing of his petition was a
<br /> bona-fide resident of liall County, Nebraska. for more than two ypars last past immediately preceding the
<br /> filing of his petition, and that the parties herein were married a.t Broken Bow, Nebraska on the 24th day
<br /> of February, 1940 as in said petition set forth.
<br /> The Cour.t further finds that more than one year ago the defendant left the plaintiff and
<br /> their minor children without cause and has been guilty of other acts of extreme cruelty, and that by
<br /> reason of the foregoing acts pl.aintiff is entitled to an absolute divorce as prayed.
<br /> I The Court further finds that there are two minor children the issue of this marriage, to wit:
<br /> F.dward L. Bierbower, 82 years of age; and Adamae J. Bierbower, 72 years of age, and. that the care,
<br /> custody and contro1 of sai.d minor children should be awarded to the plaintiff.
<br /> The Court further finds that the community property belonging to the parties herein consists
<br /> of the following, to wit:
<br /> Lots Nineteen (19) and Twenty (20 in Block Fourteen (14) in Lalk and Kriechbaum�s
<br /> I Addi.tion to Loup City, Nebraska, all in Sherman County, Nebraska; and Lot Fourteen
<br /> I4 in Blocic F.ive 5 i.n Bo s and Hills Addition to the Cit of Grand Island

<br /> ,
<br /> �ebrastca, also kno•�: as 1�J12 1Jest Eleverath Avenue, all in Hall County, Nebraska,
<br /> and that the ±itl.e to thc abozc described property should be quieted in the plaintiff.
<br /> ?T IS THRREFORF ORnF,RED, AD,)UDGEn AND DECRF.F,D BY THE COURT that the marriage contract here-
<br /> tofore existing between Ralph I:. Bierbower and Freda L. Bierbower be, and the same hereby is, dissolved,
<br /> said divorce to bec�me absolute six mon*..hs from the date of this decree unless set aside by the Court
<br /> or appeal taken,
<br /> 7T IS FURTHFR OItDFRFD, ADJtJDGF..D ANn DECREFD BY TFIr COURT that the care, custody and control
<br /> oF the minor cha.ldren belonging to the parties herein be awarded to the plaintiff; that the title to
<br /> the abave described property be quieted in the plaintiff against the de.fendan.t; and that the costs of
<br /> this action be assessed to tr,e plaintiff.
