<br /> licensed real estate broker in Grand Island, Hall County, Nebra.ska, and was such on Decemtier 4, 1948;
<br /> that I prepared the Agreement for Sale of ''Real Estate dated December 4, 1948, and recorded in Book V at
<br /> Page 341 of Miscellaneous Records in the Office of the Register of Deeds of Hall County, Nebraska, wherein
<br /> Stratton Construction Companp by Robert W. Henson as President, and by LaVerne M. Henson as Secretary,
<br /> agreed to sell to Wick Heath that portion of
<br /> Lot Fourteen (14) in Block Three (3) in Meves First Addition to the City of Grand Island, Nebraska,
<br /> North of the center of the alley to the East of said lot if it was extended West to the West line
<br /> of said Lot Fourteen {14), with other land;
<br /> that I positively know that said portion of said Lot Fourteen (14) above described was inadvertentlq,
<br /> erroneously and mistakenl.y included in said Agreement for Sale of Real Estate; that said Stratton Con-
<br /> struction Company neither owned nor claimed any right, titl� or interest in and to said Lot Fourteen (14)
<br /> or any part thereof on December 4, 1948, nor did said Wick Heath named in said Agreement for Sale of Real
<br /> Estate acquire or intend to a.cquire by virtue of said Agreement for Sale of Real Estate above described
<br /> anq right, title or interest in and to said Lot Fourteen (14) or any part thereof abave described; I ,
<br /> further positively know of my own personal knowledge that the $1,300.00 cash in hand, receipt whereof was
<br /> acknowledged by said Stratton Construction Company from said Wick Heath according to the terms of said

<br /> Stratton Construction Company nor sa�d Wick Heath on December 4, 1948, or any time thereafter nor now

<br /> � Notice is hereby given that on the 31st day of March, 1951, William Conger and Mary Esther Conger,
<br /> � plaintiffs, filed their pe�ition and actiQn in the Distric� Court of Hall County, Nebraska, against Bessie
<br /> L. Hall and Louis B. Hall, defendants, the object and praper of which petition is (l� for a judgment for
<br /> plaintiffs against defendants for monep loaned in the sum of $1,118.69, together with interest, costs and
<br /> attorneys fees; (2) that the following described real estate, namely:
<br /> Lot One (1), in Block Two (2), in John Voitle�s Addition to the �,Citp of Grand Island,
<br /> Nebraska, as surveyed, platted and recorded,
<br /> � be charged with an. equitable lien in favor of plaintiffs for such sums; (3) that the Court order a sale
<br /> of such real estate to satisfy the amount due plaintiffs from defendants, subject to the mortgage now of
<br /> record; (4) or, in lieu of (2) and (3), herein, defendan.ts shall be ordered to convey title to said above
<br />� described property to plaintiffs, free and clear of all encumbrances, except the mortgage now of record;
<br /> and, (5) for such other, further and different relief as may be just and proper.
