<br /> AGREEMENT
<br /> THIS AGREEMENT, made and entered into this 26 day of April, I947, bp and between THEODORE 0. BUSSE aml
<br /> LILLIAh BUSSE, husband and wife, parties of the first part, of Grand Island, Hall County, Nebraska, and
<br /> THOMAS G. CHAVEZ, of Grand Island, Nebraska, party of the second part, WTTNESSETH:
<br /> WF�REAS, parties of the first part, under date of July 1, 1946, purchased under contract from one
<br /> Frank S. Kosmiski a certain residential property, located at 614 North Evans Avenue, Grand Island, Nebraska,
<br /> and more particularly described as: Fractiona�]. Lot Ont (1) in Fractional Block Seven (7), John Lambertts
<br /> Addition to the City of Grand Island, and its complement, being the easterly 34.8 feet of Fractional Lot
<br /> One (1) in Fractional Block Two (2) in Evans Addition to the City of Grand Island, the west boundary line
<br /> of the west tract being a straight line extended from Seventh Street in a southerly direction to the alley
<br /> of the west line of said Fractional Lot One (1) in Fractional Block Seven (?), John Lambert�s Addition, and
<br /> by the terms of which contract they have agreed to pay the unpaid balance on the basis of $30.00 per month,
<br /> the first monthly payment to be made on or before August 1, 1946, and thereafter on the l�t day of each
<br /> month until the balance of $2,600.00 then due was paid off in full with interest at 6� starting July 10,194b,
<br /> and which interest computed semi-annually was to be deducted from the $3Q.00 monthly payments, deed to be
<br /> issued upon papment of the entire balance of the purchase price and fulfillment of the contract, which is
<br /> incorporated herein by reference; and
<br /> WHEREAS, party of the second part hae agreed to purchas�e said premi�es from parties of the first part
<br /> herein for the sum of $3,300.00, $500.00 of which has been paid or will be paid bp Map 1, 1947, and the
<br /> ' balance of $2,800.00 to be paid on the basis of $40.00 per month, commencing June 1, 194?, and a like
<br /> amount on the lst day of each month thereafter, with interest at 6% on the unpaid balance payable semi-
<br /> annually, but to be deducted from the monthly payments of $40.00 before the balance is applied on principal
<br /> as per eontract entered into by the parties hereto, dated April 22, 1947, which is incorporated herein by
<br /> reference; and
<br /> WFIEREAS, party of the first part agrees to make all payments required under their contract with Frank S.
<br /> Kosmiski, dated �uly l, 1946, out of the monthly payments received from party of the second part hereto, and
<br /> parties hereto ar� desirous of setting up an arrangement whereby all parties are assured that the intention
<br /> of the parties hereto are fully complied with; now
<br /> THEREFORE, it is agreed by and between the parties hereto that party of the second part shall, and he
<br /> hereby agrees, to pay to W. J. Bacon Realty Company the sum of $40.00 per month coiranencing Jurie l, 1947, and
<br /> a like sum on the lst day of each month thereafter, pursuant to the terms and provisions of the contract of
<br /> April 22, 1947, and the said W. J. Bacon Reaity Company, out of said payments, shall meet the monthly pay-
<br /> ments provided for in the contract of Julp 1, 1946, hereinabb�te referred to, including both principal and
<br /> interest and any other payments that might become due thereunder, to prevent a breach of said agreement and
<br /> pay the balance thereof to the parties of the first part to this agreement.
<br /> Parties of the first part hereto further agree to asssign the contract of July 1, 1946, to the party of
<br /> the second part `herein and place the same in escrow, with one copy of this agreement, unto the W. J. Bacon
<br /> Realty Company, and upon the fulfillment of all the terms and conditions of the contract of July 1, 1946,
<br /> and being the timc when the said Frank S. Kosmiski is required to execute a deed to said premises, that said
<br /> deed shall be executed in blank and delivered to the W. J. Bacon Realty Company and also held in escrow until
<br /> such time as party of the second part to this agreement complies with all of the terms and conditions of the
<br /> agreement bearing date of April 22, 1947, at which time the deed shall be delivered to party of �he second
<br /> part.
<br /> It is fnrther agreed that in the event party of the second part to this agreement defaults in his con-
<br /> tract bearing date of April 22, 1947,and resulting in a termination of said contract, that thdreupon the
<br /> sa„id W. J. Bacon Realty Company shali, upon demand, return to parties of the first part hereto the assigned
<br /> agreement had with Frank S. Kosmiski, dated ,]ulp 1, 1946, together with all moneys on hand, if any, paid to
<br /> W. J. Bacon Realty Company by party of the second part and not dispersed, and if �uch default occurs after
<br /> the deed from Erank S. Kosmiski hereinabove referred to has been delivered to W. J. Bacon Realty Company,
<br /> to return such deed to the parties of the first part hereto.
<br /> This contract shall be binding upon th� heirs, administrators, executor� and assigns of the parties
<br /> hereto.
<br /> IN WITNESS WHEREOF, the partiea have executed the foregoing Agreement in triplicate the day and date
<br /> fir�t above set for�h. `

<br /> 0. Busse and Lillian Busse are parties of the second part, which the undersigned shall hold for the purposes
<br />' hereinabove set forth and under�the terms and conditions thea��in set forth.

<br /> KNOW ALL MEN BY THESE PRESENTS:
<br /> That we, James E. Ballard and Irene Ballard, spouse of each other, parties of the first part, and
<br /> Clarence J. McIntosh, party of the second part, agree as follows:
<br /> That the parties hereto entered into a certain leasehold agreement under date of execution and
<br /> �tckn 1.c�,_`�`_edgment of November 13, 1945 which was filed of record in the office of the Register of Deeds of
<br /> Hall County, Nebraska, on November 29, 1945, in Book t,Utr, page 567 of the appropriate record;
<br /> That th� parties hereto entered into an extension agreement, extending, said leasehold agreement
<br /> referred to next above, for a term of five years; said extension agreement having been e.xecuted and ack-
<br /> now ledged on April 9, 1949, and recorded on April 15, 1949, in the office of the Register of Deeds of I�
<br /> Hall County, Nebraska, in Book «V�t at page 385.
