���� � �� � � � <br /> I�IISCEI�LANEOUS RECORD W � <br /> 88289�THE11U607TINECO.GRANDISLAND.NEBR. , . . , <br /> RIGHT-OF-WAY EASEMENT Tract No. 88 <br /> TL No, 1169 <br /> In consideration of the sum of Five Dollars ($5.0�), receipt of which is hereby acknawledged, and of <br /> the further agreements he�ein stated, the undersigned, (hereinafter called Grantors), hereby grant and con- <br /> veq to LOUP RIVER PUBLIC POWER DISTRICT, Colvmbus, Nebraska, a public corporation, (hereinafter called <br /> Grantee), its successors and assigns, a right-of way for the construction, mai�tenance and operation <br /> thereon of an electric transmission line consistiag of poles, t a+ers, wires, equipment and fi�ctures, with <br /> right to alter, repair and remove the sarne in whole or in part at any time, which right-of way shall <br /> extend on each side of the center of the line as aaw surveyed over and across the following described real <br /> estate situated in Hall County, Nebraska, viz: <br /> Section Eight, Township Twelve North, Range Ten West (Sec. 8-12N-lOW) of the 6th P.M. <br /> Grantee shall also have the right of ingress and egress across Grantorts praperty for any purpose <br /> necessarp in connection with the construction, operation, mainteaance, inspection and removal of said line. <br /> Such ingress and egress shall be exercised in a reasonable manner and as nearly as possible in conformity <br /> with the wishes of the own�r or occupa.nt of the premises. <br /> Grantee sha].1 also have the right at any time to trim or remove such trees and cuiderbrush as may in <br /> any way interfere with the safe uperation of the lines and equi�nent used in connection therewith. <br /> Crantee shall at all times exercise all due care aud diligence to avoid damage to the fences, crops, <br /> live-stock or other personal property on said reaZ estate and shall indemnify and save harmless the <br /> Grantors from any such damage occurring to such property bg reason of the construction, operation, main- <br /> tenance and removal of- said transmission lines. <br /> Grantors, their heirs or assigns, shall not allow any building or other structure, hay or straw stack, <br /> trees or any other combustible material or property to remain or be placed under or near the transmission <br /> lines, poles or fixtures in such a manner as to interfere with the safe operation or maintenance of sai.d <br /> lines or in such manner as might result in damage to the property of either party from fire or any oth�r <br /> cause. <br /> In �vent of removal of the transmission line and abandonment of the right-of way for a period of five <br /> years, then this easement shall terminate and all rights under it shall revert to the Grantors, their heirs <br /> or assigns. <br /> Grantors, their heirs or assigns, shall be entitled to the full use and en�oyment of said premises, <br /> subject only to the rights of Grantee herein conveyed. <br /> The total payment for rights herein granted ahall be �nade on the following basis: <br /> In Meadow or In Permanent Pasture or <br /> Cultivated Fields Uncultivated Land <br /> For Poles-------------------------------------Twenty-Five Dollars Each--Twelve and one half Dollars Each <br /> For Anchors with Gups-------------------------Twenty-Five Dollars Each--Twelve and one half Dollars Each <br /> For Steel Towers-------------------------------One Hundred Dollars Each--------Fiftp Dollars Each <br /> For Overhang----------------------------------Fifty Dollars Each----------Twenty-Five Dollars Each <br /> For Clearing a Strip SOf Wide On Each Side of the Center <br /> of Said Transmission Line Across the Pre�nises---------------------------.-______�M__�____��__�___ <br /> The down pay*ment of $5.00 shall be credited on the total due and final payment shall be made within a <br /> reasonable ti.me after execution hereof. <br /> Due to be constructed hereon: <br /> Five two-pole structures, in cultivable land, in su�n of $250.00 <br /> Two two-pole structures, in pasture land, in surn of $ 50.00 <br /> Total $300.00 <br /> In Presence of Mary E.
