<br /> NOt� THFRFFOR�:, in consideration of the mutual covenants and a.greements herein contained,� the parties
<br /> hereto cocenant and agree as fol.lows:
<br /> 1. The Lessor hereby lea.ses to the Lessee all of ir,s right, titl.e and interest in the above described
<br /> premises for a period beginning October 27th 1950 and terminating October 31st 1953.
<br /> 2. The Lessee hereby hires ar.d takes said prem�ses from the Lessor for the period above set forth, and
<br /> agrees to pay as renta.l therefor the sum of One l?ollar (�1.00) and other good and valuable consideration,
<br /> the receipt of which i.s hereby acknowledged by the Lessor.
<br /> 3. The Lessee, its agents, serva.nts,and employees, shall have the right at al1 times of free ingress to
<br /> and egress from said lea.sed premi.ses, through or over any other premises of the Lessor. Lessee shall also
<br /> have the right to pla.ce and mai.ntai.n its signs in and upon said premises, and on the property stored therein, �
<br /> to advertise to and serve as notice to the public that said lea.sed premises shall be opera.ted a.s a. wa.rehouse
<br /> d.uring the pera.od of this lease. The Lessee shall also have the right to the free use of all of the Lessorts
<br /> , facilities for handling, stori.ng, weighing, preserving, packing and shipping the property stored therei�n. The
<br /> Lessee i.s to ha.ve sole custody and control of the leased premi_ses and shall have the right, as a public ware-
<br /> houseman, to receive i.nto storage on the leased premises goods, wares, and merchandise a.nd i.ssue its ware-
<br /> house recei.pts therefor. Tt is expressly understood and a.greed that the Lessor shall not have access to the
<br /> lea.sed premises without the permissi.on of the Lessee, or its tlgent, and the Lessor shall exercise no control
<br /> of any kind or nature whatsoever over property on which warehouse receipts ha.ve been issued.
<br /> 4. The Lessor warrants said premi.ses to be suitable for the purpose for which they a.re intended to be
<br /> used, �.izd agrees, at its o�m expense, to keep said leased premises and. all apparatus installed therein in
<br /> constant good repair a.nd order, and to ma.intain the premises at a proper temperature to protect and pre-
<br /> ,erve the goads storea therein; and tu protect, indemnify, and hold harmless the Lessee against a.11 claims
<br /> for loss or da►na.ge of any kind or nature to the goods stored therein., or thereon, which may occ�.�r or take
<br /> place thr�ugh the failure of the Lessor to maintain such repairs, order and proper temperature, or from
<br /> any other cause whatsoever,
<br /> 5. The Lessor agrees to furnish adequate lighting for the leased premises and to pay for all heat, light,
<br /> po�aer, wa.ter, steam, or other ut:ility supplied to the premi.ses during the period of the lease. Lessor fur-
<br /> ther agrees to pay all taxes or assessments that have been or may be hereafter levied against said premises.
<br /> 6. This 1eas,e may be terminated by either party by giving a thirty (30) day written notice to this effect
<br /> to the other party. Hoti,�ever, it is expressly agreed that in case the Lessee shall have issued and there be
<br /> outstanding w�rehouse receipts on any goods stored in the leased premises, und.er no circumstances shall
<br /> this lease be terminateci until a,ll such warehouse receipts have been surrendered to the Lessee for cancel-
<br />'r lation, and until Lessor shall have pa.id Lessee all charges and advances due or owing said Lessee by said
<br /> Lessor.
<br /> 7. The Lessor a,grees to protect, indemnify a.nd hold harmless the Lessee from all claims and demands of
<br /> every person or persons whatsoever, either for injury or damage or claims thereof, to person or to property,
<br /> upon acc�unt of any�h:in.g whatsoever occurring in or about the leased premi.ses or arising out of the use and
<br /> occupancy ehereof Uy the Lessee.
<br /> £i. Should the Lessor, at any ti.me, or in any manner, violate any of the terms or conditions o�' thi.s
<br /> lease, or become i,nsolvent, or in any manner interfere with or make difficult the duties of Lesseets agents,
<br /> custodians, or employees; or should the leased premises become involved in any manner in litigation.; or
<br /> should the Lessor or the Lessee be ejected or ousted therefrom, or should proceedings be begun for that
<br /> purpose; or should the Tessee at any time deem it necessary for the protection of its interest or the prop-
<br /> erty stored, then the Lessee shall have the right to remove all the property from the premises leased herein
<br /> to such other place or pla.ces as the Lessee may deem expedient or proper; and in case of any such removal
<br /> the Lessor underta.)ces and agrees to pay tha Lessee all expenses of such removal a.nd of storing said property
<br /> elsewhe.re, inclu3ino 3_nsurance costs and attorney�s fees, until the return and surrender of all outstanding
<br /> warehouse receipts pr.operly endorsQd for delivery, and until such delivery shall have been completed, and all
<br /> payments herein referred to made.
<br /> 9. The I,essor warra.nts and guarantees the peaceful possession of said premises by the Less'�e and agrees
<br /> to execute or cause to be executed any further agreement or agreements that may be necesary to secure the
<br /> convenient use and enjoyment of the leased premi.ses by the Lessee.
