<br /> THTS AGREEMENT mad� and entered into by and between Albert J. Herman and Anna Herman
<br /> oP Hall County, Nebraska, party of the first part, and the CITY OF (�RAND ISLAND ELECTRIC
<br /> DEPARTMENT, party of the eecond par�.
<br /> WITNEBSETH: Whereas the party of the First part is the owner of SF� of the NE� and
<br /> �Ghe South 300 ft of the NW� of the NE� of Section 24, T-11-N, R-9-W in Hall County, Nebraska,
<br /> and
<br /> WHEREAS, the second party desires to construct and operate and mal.ntain one tranamission
<br /> line over and across part of said real estate.
<br /> NOW THEREFORE it is a eed by and between the parties that the second par�y will pay
<br /> to first party the sum of �1.0� and other valuable consideration, for an easement and righ�-
<br /> of-way for such purpose a� hereinafter set forth.
<br /> In consideration of the payment of sai d �1.00 and other valuable consideration, the
<br /> party of the first part hereby grants and conveys to party of the second part, its successors
<br /> or assigns, a perman�nt easement or right-of-way over and across said real estate as followa :
<br /> ON and para11e1 to the west 1.020� of' the south line of the NW4 of the NE�-- of Section 24,
<br /> T-11-N, R-9-W, Hal1 Co. ON a line 2�j0 ' sou�h of and arallel to the 1320 ' bound.�y line
<br /> between the NE4 and the SE4 of the NE�+ of same Sec 2�. Transformer to be located in the
<br /> line at a point 25�� 5outh and 30�' east of the northwest corner of the SE�F of the NE�F oP
<br /> the same sectian.
<br /> to connect wi�h the presen� transmission line as it now stands, and grants to the party of
<br /> the second part the right to trim or remove any trees along said line, or other obstructions,
<br /> so as to keep the wires cleared at least twenty feet, and to erect and set the necessary
<br /> guy and brace poles and anchors, and attach there�o the necessary guy wires, together wi�h
<br /> the right �o ingress and egress along said righ.t-of-way for the purpose of ma.king any
<br /> necessary repairs, replacements, extensions or additions to said pole line.
<br /> Said City oP Grand Island Electric Department, its suecessors or assigns, as part con-
<br /> sideration for said right-of-way, agree� to and will pay said owner, his tenanta, or heirs
<br /> or ass�gns, for all damages to live atock or other property caused by the negligent con-
<br /> gtruction, operation and maintenance or throu h breaka e of said ole line and wires and

<br /> arising out of the negligent construction, operation and maintenance of said pole Iine.
<br /> Second party obligates itself that it and its agents and employees will at all times
<br /> on entering and leaving said premises, see that the gates are properly cl.osed in order to
<br /> prevent stock from escaping from th� premises. A failure so�to do shall obligate said
<br /> second party to pay all damages occasioned thereby.

<br /> line over and across part of said real estate.
