<br /> THIB AGREEMENT m�de and entered into by and between Bertha Moore oP Grand Island, Ha11
<br /> County, Nebraska, party of �he first part, .and the CITY OF GRAND TSLAND ELECTRIC DEPARTMENT,
<br /> party of the second part.
<br /> WITNES�ETH: Whereas the party of the first part is the owner of SW� of the NE� of
<br /> Section 24, T-11-N, R-9-W in Ha11 County, Nebraska, and
<br /> WHEREAS, the second party desires to construct and operate and maintain one '�ransmiss3.on
<br /> 11ne over and across part of said real es�ate.
<br /> NOW THEREFORE i� is a reed by and between the narties that the second party wi11 pay
<br /> to first party �he sum oP �1.00 and other valuable consideration, for an easement and right-
<br /> of-way for such purpose as hereinafter set forth. .
<br /> In consideration of the payment of said �1.00 and o�her valuable con5ideration, the
<br /> party of' the firs� part hereby grants and conveys to party of the second part, its successors
<br /> or assigns, a permanent easement or right-o�'-way over and across said r�al esta�e as follows :
<br /> On a 1.ine parall�d to the wes� 300 � of and 250 ' south of the north line of the SW� of the
<br /> NE& of same section. Transformer to be located at end of easement.
<br /> to connect with the present transmission line as it now stands, and granta to the pa,rty of
<br /> the second part the right to trim or remove any trees along said 11ne, or other obstruction�,
<br /> so as to keep '��e wires cleared at least twenty feet, and to erect and set the neeessary guy
<br /> and brace polea and anchors, and a�tach there�o the neeessary guy wires, together with the
<br /> r3.ght to ingress and egress along said right-of-way for the purpose of making any necessary
<br /> repairs, replacements, extensions or additions to said pole 11ne.
<br /> Said City oP Grand Island Electric Dep�,rtment, its suecessors or assigns, as part
<br /> considerat3.on for said right-of-way, agrees to and will pay said owner, his tenant, or heirs
<br /> or assigns, for all damages to live stock or o'Gher property caused by th� negligent con-
<br /> struct3.on, operation a.nd maintEnance, or through breakage of said pole line and wires, and
<br /> agrees to hold said party of the first par� harmless Prom all 1lability of whatsoever na'�ure
<br /> arising out of the negligent construction, operation and maintenanee oP said p41e 1ine.
<br /> Second par�y obligates itself that it and its agents and employees will at all t9.mes
<br /> on entering and leaving said premises, see that the gates are properly closed in order to
<br /> prevent stock from esc�pin� �rom th� premises. A failur e so to do ahall obllgate $aid
<br /> $econd party to pay a11 damages oceasioned thereby.
