<br /> The Pipe L3.ne shall b� aonstru�ted, apera�ed, maintained, repaired, renewed and/or
<br /> reoons'Cructed by the Lieensee in striet eonformlty wi'�h Unio� Pa�ifi� :�ys�em Common S�a�dard
<br /> 8pecif�.cation 1029, whiah is hereby, by reference, made a part hereot'. A copy of aaid
<br /> Speci�ication 1029 i� on file in the oPfiQe of the Chie�' Engi�eer oY the Ra�.lroad Company
<br /> and a eopy thereoY haa heretofare been furnished ta the LiQensee.
<br /> The Lice�see shall keep and maintain the soil over the Pipe Line �horoughly aompaoted
<br /> and the grade even with the ad,�aeent a�trface of the g�ouud.
<br /> All work perPormed or� said ri�ht of way in co�neeti�n with �he eanatr�etion, mair�tenan�e,
<br /> repair, renewal or reaonstrua�ion of the Pi.pe Line shall be done unde� tMe supervision and ta
<br /> the sa'�3.sfaetion of '�he Railroad Company.
<br /> Priar to �he commenaement �of any work in connection with �he �onstruetior�, mai�t�nana�,
<br /> repa�.�, renewal or r�aonstruatiar� o�' the Plpe Line where it passes ,tznd�rneath the roadbed
<br /> and track of� tra�ks of the Railroad Compan�r, the L1e�nsec �hall submit �Go �he Railroad Com-
<br /> pa,ny plans se'�tin� out the met�.od and manner of� handling the work and sha�.I not pro�eed with
<br /> the work until such plans shall have been appro�ed by the Chief Engineer of the Ra.ilroad
<br /> Company and then only under tlze supervision of said Chief Engineer or hig author3z�d
<br /> representati.ve. The Railroad Co�npar�y shall have the r�.�h�, if it so elec'�s, to pro�r3de
<br /> sueh suppor� as l� may d�em necessary Por the aafety of' S.ts ea�.d traek or tracke during
<br /> the time o�' conatrua�9.on, main�ena.nae, repair, renewal or reconstruction of the Pipe L1ne,
<br /> and in the event the Railroad Company provides such suppnrt the L3cenaee shall pay to the
<br /> Railraad Company, within fifteer� day�a af'�er bills �hall have been rendered �herefor, a11
<br /> expens� ineurred by the Railroad Company 1.n Qonneation therewith, which sa�.d expen�e ahall

<br /> 3eotion 3. NOTICE �F COMMEIJCEME�JT OIi' W�RK.
<br /> The L3censee aha11 notify the Railroad Company at leas� forty-eight ho�,�a in advanes
<br /> o�' the commencement of any work upc�n said ri�ht of way in Qonneat3.on with the Qonstruetion,
<br /> ma.intenance, repa�.r, renewal or reconstruction c�P the Pipe L�.n�.
<br /> Section 4. LICENSEE T� BEAR ENTII�E E'XPEIQSE.
<br /> The License� shall bea,r �he entire aost and expense ineurred in conneetion� wi�h �he
<br /> aonetruction, mainte�2anae, repair �.nd rer�ewal az�d a�y and all mod3.fieation, reviaion, re-.
<br /> location, � removal or reaons�rUCtion o� the Plpe �,ine, inelucl�.n� an�r and all expense which
<br /> may be incurred by �he Ra3lroad Company in eonnection tY�erewi�h for supervision or lnepeat3on,
<br /> or dtherwise. -
<br /> Section 5. MODIFICATTON OR RELOCATTON OF PIFE LTNE.
<br /> TMe Licensee shall, at its se,le expenae, make any a,t�d all mod�.ficatiens or changes in
<br /> the Pipe Llne, or move all or any par� th�reof to such Mew laeatian as may be required by
<br /> �he Ra�.lroad Company a'� any tlme, in conneetion with the construe'tion, maintenance, repa�.r,
<br /> renewal, use, operatlon, � change, modiP�.ca�ion or relocation of railroad �racka, telegraph,
<br /> '�elephone, aignal or other pole and w�.r� lines, pipe line8 a�d other facsi�.ities of �he
<br /> Ra,ilroad Company upon 8aid right ot wa�.
<br /> All the termc, condi�lons and stipulations herein expressed wi'�h referenas to the
<br /> construc�ion, mainteriance, repair an� renewal of 'Che Pipe L�.ne on said right of way in the
<br /> location hereinbefore describ�d shall apply to the P3pe L3ne as modified, changed or re-
<br /> loeated within the contemplation oP �Ghis seotion.
<br /> Bee�ion 6. PIPE L2NE NOT TO TNTERFERE WITH OPERAT2�N OF RAILROAD.
<br /> The Pip� Line shall be construeted and, a�G �,11 times, maintained, repaired, renewed
<br /> and operated 3.n su�h manner as '�o eause no interferen�e whatsoever with the eor�stant, eon-
<br /> tinuous and un�nterrupted use of the traaks, property and premises of �the Ra.ilroad Compan�r,
<br /> and nothing shall be done or sufYs�ed �o be done by the Licensee at any time that would in
<br /> any manner impa�r the safety thereof.
<br /> 9ee�ion 7. CLAIMS AND LIEAtS F�R LABOR AND 1�ATERTAL-TAXEB.
<br /> The �icensee sMall fu21y� pay for al1 ma�erlals �oined or affixed to and labor perPormed
<br /> upon said right of way in connectiQn �lth the construetion, maintenance, repair, renewal or
<br /> reconstrue'�ion of the Pipe Line, a,nd shall not permit or suYPer any mechaaic�e or ma'�er�.a1.-
<br /> man's lien of any kind or nature to b� enforoed agains� said righ� of way for any wor� done
<br /> 3 or ma.'�erials furnished thereon at the instance or rsquest or on behalt' ot' the Licensee, and
<br /> the Licensee shall indemnify and hold harmless the Railroad Companq Prom and against any ..ry
<br /> and all li.ens, alaims, demands, easta and expen�es of whatsoever nature in any way conneeted �.',
<br /> with or growin� out of auch wark don�, labor p�rformed, or materiale furniahed.
<br /> The Licensee shall promptly pay or dischar�e all taxes, rates, charges and assesBments �
<br /> levied upon, in respec� to, or on aacount oP the Pi.pe Line, so ae �o prevent the same becom- `"�
<br /> ing a charge or lien upon s�.id ri�ht of way, or an� other property o� the Railroad Company, ,
<br /> and so that the taxes, charges and assessments levied upon or in respec� to said rl.ght of '
<br /> way and other property o� the Railroad Comgar�y shall no� be increased because ot the loca- �
<br /> tion, ccn�truction or ma.intenance of the Pipe Line or any improvement, applianee or fixture '
<br /> cor;nec�ed therewith placed upon said ri�ht of way, or on aecoun� of the Lieensee 's interea�
<br /> therein. Where such tax, charge or asseas�nent may not be separately made. or assessed to
<br /> the Lleensee but sha1.1 be included in the assessinent of the ri$h� af way or other property
<br /> of the Railroa.d Company, �hen �he Licensee sha11 pay to the Railroad Compa,ny an equitable
<br /> proportion of such taxes de�ermined by the value of the Licensee �e property upon said right
<br />�
<br /> of way a� �ompared with the entire value oP said right of way. °°:�°
<br /> 8ectian �. RESTORATI�N OF AAILROAD G�MPA�TY�3 PROPERTY.
<br /> In the event the Licensee sha,ll take down any fence oP the Railroad Company or in any
<br /> manner move or dieturb a�nq of the ather property of the RailrOad Company in Qonneetion wlth
<br /> the eonstruction, maintenance, repair, renewal or reconstruc�3.on of the Pipe L3ne, �hen and
<br /> in that egent the L�.censee ahall, as soon as posaible and at its eole expense, restore sucah
<br /> fence and/or such other property to the same conditic�n as it was in before such fenee was
<br /> taken down or sueh other property was moved or disturbed, and the Lieensee �hall indemnify
<br /> and gace harmZesa the Railroad Company from and aga.inst any aMd all liability, loss, da,ma,ges,
<br /> claims, demands, costs and expenses of wha'�soeve� nature, inelud3.ng csourt Qos�a and attor-
<br /> neys ' fees, which may resul� fr�om in,�ury to or dea'�h of :persons whomsoever, or dama�e to
<br /> or loss or destruction of property whatsoever, when sueh in�ury, death, damage, loas or
<br /> destruction �rows out of or arises Yrom the taking down oP any fence or the movin� or dis-
<br /> �urbance of any of �Ghe o�her property of the Rallroad Compa,r�y.
<br /> 3ection 9. DTSPOSAL OF PR�PER�'Y.
<br /> In the event the Ra.ilroad Company ahall dispose of any of its proper�� upon which t�e
<br /> Pipe Line is loca�ed, as herein provided, the license or permit he�ein granted, with re�pect '
<br /> to the portion of the Pipe Line loca�ed upo� the proper�y �o dispo$ed of,shall forthwith
