<br /> THIS AGREEMENT made and entered into by and between Larry W. Bank & C1ara Bank of Hall
<br /> County, Nebraska, party of the first part, and the CITY OF GRA1�D ISLAND ELECTRIC DEPARTMENT,
<br /> party of the second part. �
<br /> WITNESSETH: Whereas the party of �he firat part is the owner of N� Sec. 26 -
<br /> '�ownship 11 - Range 10 Center Township in Ha11 County, Nebraska, and
<br /> _ WHEREA9, �he second party desires to construc� and operate and maintain one transmisaion
<br /> line over and acroes part of said real estate.
<br /> NOW THEREFORE it is a reed by and between the parties that the second party will pay
<br /> to first party �he sum of �1.00 and other valuable considera�ion, Por an easement and righ.t-
<br /> of-way Por such purpose as hereinafter se'G forth.
<br /> In consideration of the payment of sai-d �1.00 and other valuable considera'�ion, the
<br /> party vf the first part hereby grants and conveys to party of the second part, its sue-
<br /> • cessors or assigns, a perm�nent e�.sement or right-of-way over and across said real estate
<br /> as follows: Starting at a point on north side of Hi-way #30, where the east roper�y line
<br /> of the SW� oP Sec. 26-T 11 - R 10 intereects, runn3ng north �o middle of S.W.� sec. thence
<br /> running west � mile through center oP SW� sec. to county road on west side of said section.
<br /> Approx. --
<br /> to connect with the present transmiasion line as it, now s�ands, and grants to the party oP
<br /> �he second part the right to trim or remove any trees along sa3d line, or other obs�ruction�,
<br /> so as to keep the wire� cleared at least twen�y feet, and to erec'� and set the necessary
<br /> guy and brace poles and anchors, and attach thereto the necessary guy wires, together with
<br /> the right to ingress and egress alon� said right-of-way for the purpose of making any
<br /> necessary repa3.rs, replacements, extensions or additions to said pole line.
<br /> Said City of Grand Island Elec�r3.c Depa,rtment, 3ts succeasors or assigns, as part
<br /> consideration for said right-of-way, agrees to and will pay said owner, his tenant, or
<br /> heirs or assigns, for all damages to 13.v� stock or other property caused by the negligent
<br /> aonstruction, operation and maintenance, or through breakage of said pole line and wires,
<br /> and agrees to hold �a3.d par�y of the first part haxmless from all liability oP whatsoever
<br /> nature arising out of the negligent construction, operation and maintenance of said poie
<br /> line.
<br /> - Second party obligatee itself that it and its agents and employees will at all times
<br /> on entering and leaving said premises, aee that the gates are proper�y closed in order to
<br /> prevent stock �'rom e�caping from the premises. A failure so to do shall obligate said
<br /> second party to pay all damages occasioned thereb�.
