<br /> This A�reemPnt, Made this 15th day oP December, i94� by and between Margaret Kiekbusch and
<br /> Emil H. Kiekbusch wife and husband parties of the firs� part (Lessor) , and George B.
<br /> Coulter and Eula G. Coulter, husband �.nd wiPe parties of the second pa,rt (Lessee) ,
<br /> WITNESSETH, That the said pa,rties of the first part, in consideration of the covenants
<br /> by the second parties hPreinaf'�er set forth, do Lease and Demise to said par�ies of the
<br /> second p�,rt the following described premises in the City of Wood River the County of Hall
<br /> and Sta.te of Nebraska, to-wit:
<br /> Lot Four (4) Hlock Twenty Five (25) Original Town of Wood River, Hall County,
<br /> Nebraska
<br /> together with all buildings and improvements equipment on the sa,me for the term of One (1)
<br /> ,year from the lst day of January, 19�9•
<br /> � TO HAVE AND Tp HOLD the same to sa3.d second par'�ies without any obligation or liability on
<br /> the part of firs'G parties of making any alterations or repairs of any kind on or about said
<br /> premises.
<br /> And said parties of '�he second part in consideration oP the leasing of the premises
<br /> as �.bove set forth, covenants and agrees with the parties of the first part to pay said
<br /> parties of the first part ' at the office of Hoye Ins. Agency Wood River, Nebraska as rent
<br /> for the same, the sum of Seven Hundred Twenty a,nd No/100 (�720.00) - - - - - - DOLLARS.
<br /> Payable as Pollows to-wit: Three Hundred Sixty (�360.00) and no/100 Dollars payable upon
<br /> the signing of this lease. The bal�.nce of �360.00 payable on or before the 30th day of
<br /> June, lg�-9.
<br /> The said Lesaor covenants and agrees that said premises are received by said Lessee
<br /> in good order and condition except as to basement
<br /> It is further agreed that if any rent sha1l be due and unpaid, or default has been
<br /> made in any of the covenants herein contained, it shall then be lawful for said first
<br /> . partiea to re-enter said premises and the aecond parties agrees to vacat� said premises
<br /> without notice.
<br /> The Lessee fur�her agrees that they will not deposit ashes, garbage, or any other
<br /> offensive matter on said premises but at h own expense keep said premises and alley
<br /> ad�jacent thereto continually in neat, clean, and �aholesome condition; will keep sidewalks
<br /> in front of and along said premises cleared of snow and ice or other ob,�ectionable things
<br /> as the City Ordinances or Authorities may require. That �hey will pay for all City Water
<br /> used on s�.id premises during �he term of this lease and be responsible Por and at his own
<br /> expense keep in repair all plumbing, hydrants, water pipes, gas pipes, steam pipes, and
<br /> sewerage or other fixtures, zncl.uding window glass and shutters, and '�hat said Lessee will
<br /> not suffer or allow any damage to fences, .walks, barns or other improvements belonging to
<br /> said premises. That said Lessee will not allow any intoxicating liquor to be sold on the
<br /> premises nor any gambling or other immoral or unlawful practices, to be done thereon, nor
<br /> anything ther eon calculated to in,jure the reputation or impair the value of the premises
<br /> or the ad,jacent property or the neighborhood, and that said Lessee will not assign this
<br /> Lease nor underlet said premi$es without tne consent of said Lessor in writing. And said
<br /> Lessee further covenants with the Lessor, th�.t at the expiration oP the time mentioned in
<br /> this Lease peaceable possession of' the said premises shall be given to the Lessor in as
<br /> good condition as they naw are, or may be at any time during the term of this Lease; that
<br /> upon the non-payment oP the tirhole or any portion of said rent at the time when the same
<br /> is above promised to be paid, or upon the violation or non-fulfillment of any of the cov-
<br /> enants of this Lease, the Lesaor may, at their election, declare this Lease at an end and
<br /> recover possession as iP the same w�re held by forcible detainer; the Lessee hereby waiving
<br /> any notice of s�aeh el�etion, or any demand Por the possession of said premises.
<br /> 5aid premises shall be used for Cafe and etc. business only; that they will not per-
<br /> mit any noise or nuisances whatsoever on the said premises to the disturbance of the tenants,
<br /> or to not permit anything on or about said premises which might increase the rate of insur-
<br />' a,nee and tne Lessor, 'ther_ agents may enter at any time to view said premises or for any
<br /> necessary purpose. .
<br /> IT IS FURTHF,R AGREED, that the Lessee ahall have the Option to purchase the here-in
<br /> described property on or beYore the expiration date of this Lease for a purchase priee not
<br /> to exceed Five Thousand �,nd no/100 ( �5, 000.00) Dollars. A1so that the Lessee shall have
<br /> the privil�ge aP sub-letting. that Lessor shall have the right to put up '�For Rent" notices
<br /> and show the premises at reasonable hours for th�rty days prior to the expirAtion of this
<br /> Lease and, at reason�ble times, may make necessary repr�.irs for the proper preservation of
<br /> said premises.
<br /> In case the buildings on said premises shall without f ault or negleet on the part oP
<br /> the Lessee or of their servante or employes, be destroyed or be so damaged by the el.ements
<br /> or for any cause be untenantable or unfit for oceupancy, then the liability of the Lessee
<br /> Por the payment of rent hereunder, and alI rights to possession thereafter shall �henee
<br /> ceage. '
<br /> Said parties of the second part hereby granta to the said parties of the first part a
<br /> lien upon any and all property of said second parties kept in use upon sAid premises to be
<br /> enforced in like manner as a chattel mortgage, whether exempt from executlon or not, for
<br /> all rent due or to become due by virtue oY this Lease.
<br /> The covenants herein shal3 extend to and be binding upon the heirs, executors, ad-
<br /> ministrators, assigns or trustees of the parties to '�his Lease.
<br /> The agreementa made on the back of this Lease shall be deemed a part oF the same as
<br /> though T�rritten out above.
