<br /> to th� City of Grand Islana, Nebraska; Clifford L. Eschliman and Edith M. Eschliman are the
<br /> owners of the Center f or�y-four (4�) feet of Lots Nine (9) and Ten (10) , Block Tiaenty-One
<br /> (21) , Schimrner� s Addition to the City of Grand Island, Nebraska; and Orvall W. N.arum and La
<br /> Neva P. N arum are the ovrne rs of the Northerly f orty-f our (44�) f e e t, of Lot s N ine (9) and
<br /> T�n (10) , B1ock Twenty-One (21) , Sehimmer' s Addition to the Ci�y of Grand Island, Nebraska,

<br /> WHEREAS, certain utilities now traverse said Lots Nine (9) and Ten (10) , Block Twenty-
<br /> One (21) , Schimmer' s Addition to the City of Grand Island, Nebraska, and aaid utilities
<br /> serve the various ownerships above set forth, and
<br /> ��'HEREAS, the o��,mers of said premises above d+�scribed desire to enter into an agreement
<br /> for the benefit of each other, whereby an easement wi21 be granted to each of them f or the
<br /> benefit oP the other by the . terms of which the u�ilities now traversing the premises may re-
<br /> main in their present location to provide utility service for a11 of the premises; and to
<br /> provide �ha'� the utilities under each premises shall be maintained by �he ownera of said
<br /> premiges.
<br /> IT IS, THEREFORE, AGREED by and between the undersigned part3.es that the utilities now
<br /> traversing �he above described premises shall remain in their �resent location and an ease-
<br /> ment is hereby granted, by each of the above named owners for the benefit of the other to
<br /> accomplish such purpos�; that in order to maintain said utilities in an operatin� condition,
<br /> each of the okrners will r�aintain said utilities under �heir own premises. In the event it
<br /> becomes necessary for one oVmer to trespass upon �roperty owned by another of the under-
<br /> si�ned f�r the purpose of such maintenance, permission to do so is hereby granted. The
<br /> terms of' this agreement sha11 extend only to utilities now located on the premises; the
<br /> terms of this agreement shall be cons3.dered a covenant running with the land and shall be
<br /> binding upon the heirs, executors, successors and assigns of the undersigned. The considera-
<br /> tion for this agreement sha11 be the mutual benefits to and covenants of the parties hereto.
<br /> l�othing herein contained shall prevent the owners of the premises from mutually annulling
<br /> thiq agreement or making mutua.l provision for change in location of such utilities.
