<br /> purpose to take, use, occupy and en��y a strip of land of the uniPorm width of ei�ht and
<br /> one-half (8�,5� feet on each side of �Ghe cen�er line of said track as shown colored red on
<br /> aforesaid print.
<br /> TO HAVE AND TO HOLD the sald right, Iicense and privllege unto said party of the second
<br /> part, lts suceessors and ��signs, forever, sub�ect, however, to this condition, that if at
<br /> any tlme after the construction oP eaid traek the aaid second party,, its successore or
<br /> assigns, shall permanently abandon the use of said traak and remove the same, then the
<br /> said right, license and privilege shall cease and determine.

<br /> JAKE GR.ASMICK, being firat duly aworn on his oath, deposes and says that he resldes at
<br /> 1712 North Eddy Street in the City of Grand Island, Hall County, Nebraska; that on or about
<br /> the 12th �f February, 1938, affiant purchased the Home in which he now residea at 1712
<br /> North Eddy Street, the lega]. description of �he same being Lot Four (�) of Gilbert � s Sub-
<br /> division of Block One (1) of Gilbert� s Second Addition to the City of Grand Island, Hall
<br /> County, Nebraska, Prom the Home Owners Loan Corporation, under a contract da�ed February
<br /> 12, 1938; that the terms of sa�.d contract hav� been carried out in ful3 by the affiant,
<br /> and that sald premises are now occup:�Ed by affiant and his family as their home.
<br /> Affiant further statea that he is in favor of the construetion of a sewer in the alley
<br /> ad�oining the above-�escribed property, and that affiant is willing to pay the proportional
<br /> cost of gaid sewer which may be rightfully taxed a�ainst afPiant' s property, and that he
<br /> has authority to consent to the construction of said sewer and to the assessment of hls
<br /> rightful share of the co�ts thereof on the same basis that the other proper�y owners
<br /> effected by said sewer shall be aseesaed.
