<br /> An ordinance approving the report of the appraisera in the condemnati4n proceeding
<br /> with respect to the Sycamore Street underpass, ordering the payment of the "sums ,found to
<br /> be pay�.ble; a.uthoriZing the purchase of one small tract of ground to be paid fca_r out of
<br /> the Gener�.l Fund; directing the isauance oP warrants and deposit of money; and the taking
<br /> of the possession of the property appropriated by the condemnation proceeding.
<br /> ��f-IEREAS, at the election held on the 6th day of April, 19��, there were Four Thousand
<br /> Six Hundr ed & Forty (46�-0) votes cast, in-favor of the construction of the Sycamore Street �
<br /> underpass and Four Hundred �ne (401) votes against, and said ballots have been canvassed
<br /> and the proposition declare� carried.
<br /> NOW, THEREFORE, AE IT ORDAINED BY the t�ayor and City Council of the City oP Grand .
<br /> Island, Nebraska;
<br /> SFCTION l. That the awards m�,de by the appraisers for the property appropriated for
<br /> or damaged by the Sycamore Street underpass, as appointed by Ordinance No. 217� of the
<br /> City of Grand Island, Nebraska, be and the same are hereby approved by the City Council of
<br /> the City of Grand Island, Nebraska. �
<br /> SECTION 2. That there is hereby temporari].y borro�red from the Light & Ice funds of
<br /> the City af Grand Island, to be reatored to said funds within a reasonable time hereafter,
<br /> the sum of Fifty-eight Thousand & no/100 Dollars ( �5�,000.00) , for the purpose of making
<br /> tha payrnents required to be made by virtue of said condemn$tion proceeding, which funds so
<br /> temporarily borro�aed shall be placed in a Pund designated as the �"Sycamore Street Condem-
<br /> nation Fund. "
<br /> SECTION 3. The Mayor and City Clerk axe hereby directed to draw warrants ori said
<br /> fund so created, and to deliver said warrants in �ayment of the damages so found by the
<br /> ap�raisers, as follows, to-wit : -

<br /> SECTION �. The City of Grand Island �hereby accedes to the recommendations oP the
<br /> appraisers with respect to the elaim of Harry Priesendorf and does hereby agree to pay the
<br /> cost of reconstructing the sidewalks on the south and west side of Lot 5 in Block 53, of
<br /> - the Original Town, a.nd one-half oP the said sidewalks on the south side and west side of
<br /> said lot to be sloped to the street, a.nd on that basis, approves the award of the ap�araisers
<br /> to Harry PriesendorP, as owner, and to Robert Hagman and Joseph A. Elder; as Leasees, in
<br /> the total sum of Seven Thousand Dollars ( �7000.00) and further approves the apportionment
<br /> as follows: Haxry Priesendor#';, owner, -���500.00; Robert Hagman and Joseph A. Elder, as
<br /> Lessees, �2500.00. The fore�oing approval of the apportlonment shall not be construed as
<br /> a waiver oP the right of the City of Grand Island to claim that the tenants have suffered j
<br /> no compensable damages by rea3on of the condemnation.
