<br /> This ca.use coming on to be heard this 6�h day of April, 194�, upon Motion of plaintiff
<br /> for dePault of the defendants, �nd the Court having examined the files, Pinds that
<br /> service by publication has been had upon alI of said defendaa�ts as by law requir,ed and
<br /> time for said defendants to answer or plead to plaintiff' s Petition having elapsed, that
<br /> plaintiff, by her attorney, has filed an affidavit with respect to such of those deYendants
<br /> who are now engaged in the military service of the United States of America or an y of its
<br /> Allies, or are under order to report for induction therein or are a member of the Enlisted
<br /> Reserve Corps under order to report for such service and by an y oP said reasons deprived
<br /> of an ot��ortunity to answer bl�.intiff� s Petition herein filed or thereby prevented from
<br /> appearin� in said cause and the Court havina appointed C. E. Cronin attvrney f'or such of
<br /> said defendants, and he having filed his Answer herein, the Court finds that all other
<br /> defendants are in default for answer, plea or demur to plaintiff ' s Petition and their
<br /> default is hereby duly t�,ken and entered .against them.
<br /> This cause coming on for trial upon the �etition oP plaintiff and Answer of C. E. Cronin
<br /> as attorney for those de�endants herein who are now engaged in the r�iilitary Service of the
<br /> United Sta.tes of America or any of its Allies, or are under order to report for induction
<br /> therein or are a member of the Enlisted R�serve• Corps under order to report for su ch
<br /> service and by any of said reasons deprived of an opportunity to answer plaintiff' s petition
<br /> herein Piled or thereby prevented from appearing in said cause, and after hearing the
<br /> testimony adduced in support of plaintiff� s Petition and there being no other testimony
<br /> oPPered in said cause, the Court finds generally in favor of plaintiff and against all oP
<br /> the defendants herein; the Court further finds all of the allegations of plaintiff ' s
<br /> Petition to be true, that Harry M. Gilchrist died at Julesburg, Colorado, October 27, 1940,
<br /> and that his lawful issue and all of hia lawful issue him surviving on that date were:
<br /> Wilbur C. Gilchrist, Earl L. Gilchrist, Harry D. Gilchrist, Bethna Jane Duncan, Harold M.
<br /> Gilchrist, Loren R. Gilchrist, Gene E. Gilchrist, inJilliam R. Gilchrist and Virginia Lee Brown.
<br /> The Court further finds that upon the death of said Hax°ry M. Gilehrist, under and by
<br /> virtue of the proviaions of the Last Will and Testament of Robert C. Gilchrist, deceased,
<br />. a certi�ied copy of ��hich Will and final decree oP the County Court of Hall County,
<br /> Nebraska, in the Matter of the Estate of Robert C. Gilchrist, decea.sed, was Piled Oetober �,
<br /> z9�3, in tne office of tne Register of Deeds of Hall County, Nebraska, and there recorded
<br /> in Book 1 of t�lills and Decrees at page 47�, sai� Wilbur C. Gilchrist, Earl L. Gilchrist,
<br /> Harry D. Gilchrist, Bethna Jane Duncan, Haxold M. Gilchrist, Loren R. Gilehrist, Gene E.
<br /> Gilchrist, T,i�illi�,m R. Gilchrist and Virginia Lee BroT�un, were the owners of said real estate
<br /> in fee; th�t by virtue of the warranty deed recorded in Book �9 at page 673 of the Deed
<br /> Record.s of Hall County, Nebraska, said Grace A. Gilchrist, plaintiff herein, became the
<br /> owner in f ee simple of the Northea�t Quarter (NE�� of Section Eleven (11) in Township
<br /> Ten (10) North, Range Ele�ren (11) , West of the 6th P.M. in Hall County, Nebraska, in fee
<br /> simple absolute and is the o�aner thereof a.nd that the dePendants and each and al1 of them
<br /> have no right, title or interest in �nd to s�,id real estate or any part thereof.
<br /> IT IS THERFFORE ORDERED, ADJUDGED AND DECR�'ED that said plaintiff Grace A. Gilchrist be
<br /> and hereby is declared to be the owner in fee simple of the Northeast Quarter (NE�) of Seetion
<br /> Eleven (11) in Township Ten ( 10) North, Range Eleven (11), West of' the 6th P.M. in Hall
<br /> County, Nebraska, and that her title is absolute as against said d�fendants and each and
<br /> all of them and that said def endanta and each and all of them have no right, title or
<br /> interest in and ta said premises or any part thereof as against plaintiPf.
<br /> The costs of this aetion in the 9um of �35.22, including a fee for C. E. Cronin
<br /> heretofore appointed attorneyH�re�n b,y the Court, are hereby taxed against plaintiff.
