<br /> December 19, 1947, entered decree. This cause coming on for heaxing upon petition of
<br /> Virgil E. N�rthwall, Guardian of Paul Kosack, incompetent, for license to sell the real
<br /> esta,te of said ward, and on the order to sho��► cause heretofore entered in this cause, and
<br /> the eertificate of approbation of the County Commissioners of Douglas County, N�braska.,
<br /> approvin� proposed sale, and the evidence, the Cou rt finds that the Court ha,s �urisdiction
<br /> of the narties and the sub,ject matter herein, a,nd that the several allegati.ons of the
<br /> pe'�ition of said Guardian are true.
<br /> That Virgil E. Northwall is the duly a.ppointed, qualified and acting Guardian of Paul
<br /> Kosack, incompetent, under appointment by the Coun�y Court of Douglas County, Nebraska,
<br /> being 'Ghe Court having �urisdiction thereof.
<br /> That among the assets belonging to said ward ���hich ha.ve come into the hands of said
<br /> Guardian, is the followin� described real estate in Hall County, Nebraska, to-wit:
<br /> Lot 14 of Vantin� !s Subdivision, being a p�r t of the North West 4 of Sect ion 22, Township 11,
<br /> North of Ra.nge 9, West of the 6th P.M.
<br /> Tha.t it would be forg the �enefit of said ward that sa.id property �be sold and the
<br /> proceeds thereof be nut out at interest or invested in some �roductive stock.
<br /> That the certificate oP approbation of the County Commissioners of Douglas County, Nebraska,
<br /> as provide� by law, has been duly filed in these proceedinos, approving of the proposed sale,
<br /> and that an order to shota cause why license should not be gr�.nted as applied for has been
<br /> duly, published for three weeks in The Daily Record, a legal newpaper of 33ouglas County, Nebrask� ,
<br /> pursuant to the order of this Court, and that the next of kin of said incompetent and all
<br /> persons interested in his estate have been duly notified to appear before this Court to
<br /> show cause why lieense should not be granted for the sale of said property, and`�h�t. no
<br /> cause has been shown why license should not be so granted.
<br /> It is therefore ordered, ad,judged and decreed that Virgil E: Northwall, Guardian of
<br /> Paul Kosaek, incompetent, be and he is hereby authorized to sell the property oP said
<br /> i.nco,m�etent hereinbefore deseribed, the proceeds therefrom to be put out at interest or
<br /> invested in some productive stock.
<br /> That the said sale be had a'G public auction to the highest tiidder, the same to be
<br /> sub�ject to the approval of this Court. That said s�,le be held at Grand Island, Hall County,
<br /> Nebraska, a.nd. th�t prior to said sale, said Guardian take and subscribe oath as required
<br /> by statute, ancl give public notice of the time, place and terms of the said sale in the
<br /> manner provided by law.
<br /> Th�t sai� Gu��.rdian re?�ort his proceedings to this Court and that the proceeda of said sale
<br /> be r.ut out �,t interest or invested in some productive stock, a,nd that any investment of said
<br /> procee�s by the said t�uardian sha.11 be according to the Guardian' s beat ,�udgment, or pursuant
<br /> to any order that may be made by this Court.
<br /> It is further ordered that prior to said sale, said Guardian oive a bond as required
<br /> by 1aw in �he sum of �1500.00.

<br /> duly executed, showing that the printed notice thereto attached was publi-shed in The Grand
<br />� Island Daily Independent, Por three weeks, on January 20, January 27 a,nd February 3, 194�.
<br /> . February 14, 194�, -filed report and return of sale, and motion for conPirmation thereof.
<br /> Comes no« Virgil E. Northwall, Guardian, and herewith makes report and return of his proceedings
<br /> in the sale of the fo�:lowing described real estate:
<br /> Lot 14 of Vantine� s Subdivision, being a part of the North West � of Section 22, Township 11,
<br /> North Range 9, West oP the 6th P.M. in Hall County, Nebraska.
<br /> That pursua.nt to the license granted to him on December 19, 1g47, he executed a bond
<br /> as required by the Court, which was duly approved by the Court, and took the oath reauired by
<br /> law, and filed said oath and_ bond with this Court, and thereupon gave notice of the time and
<br /> place oP said sale by publication for three successive weeks bePore such sale, a copy of said
<br /> noti ce o�' sale, together with an �fPidavit of the Manager of said newspaper showing publication
<br /> thereof, being hereto �ttached and by a reference made a part hereof. -
<br /> That pursuant to the terms of said notice and at the time and place therein stated,
<br /> said real esta.te above described was ofPered for sa.le at public auction to the highest bidder,
<br /> and kept said sale open for a period of one hour, and sold said real estate to Paul C. Huston
<br /> for the sum of �1850.00 cash, he being the highest bidder, said pro}��rty to be free and clear
<br /> of all taxeg, both regul�r and special; th�.t said sale wa.s in all respeets regularly made
<br /> and �a,irly conducted, and the sum bid and accepted �aas not disproportionate to the value of the
<br /> property so1d, and tha.t � greater sum than bid and a.ecented Por said pro�serty cannot be obtained.
<br /> Th�t Guardian exerted his best endeavors to sell said real estate in such manner as would
<br /> be most for the advantage of said incompetent. Tha.t in his opinion, no greater sum or better
<br /> bid than above s�ecified, can be obtained for the same and tha,t an order should be entered,
<br /> and said Guardian hereby moves the Court to enter its or.�.er conPirming said sale and directing
<br /> a conveyance to be executed and delivered to the purchaser, upon payment of the �1�50.00 cash
<br /> consideration to be �aid thereon.
