<br /> (4) ��AINTENAr�CE. (a.) Lessor agrees to maintain said premses and improve�ents including
<br /> plumbing, heating and electric wiring in good repa.ir during the term of this lease (except
<br /> as hereafter in sub-section " (b) " of this clause provided) and to rebuild within sixty (60)
<br /> days any structures on said premises damaged or destroyed in any manner. In the event of
<br /> lessor ' s failure to do so, lessee, at its election, may either terminate the lease on thirty
<br /> (30) d�,ys � notice to lessor, in which event rentals sha.11 abate Prom the date of destruction
<br /> or dar�age, or do the necessary repairing or rebuilding at the expense oP the lessor and have
<br /> the right to a��ply accruing rentals for the purpose of reimbursing itself for principle
<br /> expenditure, together �aith interest at si.x per cent. If, during the time the premises are
<br /> undergoing repairs, the use thereof by lessee is materially interfered with, the rent accruing
<br /> during such period shall be abated.
<br /> (b) During the term of this lease, lessee shall maintain all mech�.nical equipment
<br /> (except �s provided in Paragraph (�+) (a) in good repair, and, whenever it deems necessary,
<br /> shall paint structures on said premises.
<br /> ( 5) RFMOVAL OF PROPERTY. Lessee shall have the right at any time during the continuanee
<br /> of this lease or within thirty (30) days after its termination to sever and remove a.11
<br /> buildings, and im�rovements, fixtures, equipment and other property owned by lessee or
<br /> placed on said �remises by lessee during the term of this or �ny �revious lease, or a,ny
<br /> extension or renewal thereof. .
<br /> (6) LESSEE ' S RIGHT OF TERMINATION. Should lessee, for any reason other tnan (a) any
<br /> sailful act of lessee and/or (b) damage or destruction of nremises and/or any structurea thereon,
<br /> be ?�revented from establishing or continuing the business� of distributin petroleum products
<br /> on said nremises, lessee may terminate this lea,se uT:�on giving thirty (30� days:4 written notice
<br /> to leasor, in T�hich event the rental obligation shall be prorated to the d�,te oP such
<br /> termin�tion. �
<br /> (7) DAr•?AGES FOR DEFECT IN TITLE, Lessor covenants that he is well seized of eaid nremises,
<br /> has good right to lease the s�.me, and �arrants and agrees to defend the title thereto; and to
<br /> reimbuurse and hold lesseP h�rmlPSS from al,l da�mages and expenses ?ahich lesaee may suffer
<br /> by rPason of any r�striction, encumbrance or dePect in such title.
<br /> (�) TAXES AND E��1CUt�2BRAi�CES. Lessor agrees to pay all t�,xes, assessments and obligationa
<br /> whieh are or may bec�me a lien on the demised premises and improvements .as they become due.
<br /> If' lessor should fail to do so, lessee, shall have the right either to make such payments for
<br /> the account of lessor, in which event it shall be subro��.ted to all the rights of the holder
<br /> oP such lien, and in addition thereto shall h ave the right to apply accruing rentals in
<br /> s�.tisfaction of such obligations; or lessee, in the event of a Poreclosure of any such lien and
<br /> the sale of said demised premises and improvements, sha11 ha,ve the right to bu� in said premises
<br /> a,nd improvements for its oT�rn account. '
