<br /> certain *.,rarranty deed, conveying the a.bove descrioed premises, which deed bears date of
<br /> September 29, 1909, and is recorded in Book 45 at P�ge 153 of the deed records of Hall
<br /> County, Nebraska., �nd is a.lso a.cauair�ted ?�ritn Clarence R. Helber, one of tne grantors in a
<br /> wa.rranty deed, conveying the a,bove described nremises to Ch��.rles L. Rickard, which deed
<br /> bears date of December 17, 1910, and is recorded in Book �+7 �.t Pa�e 164 oP the deed records
<br /> of Hall Count3�, Nebr�,ska, �nd affia.nt positively knoT�rs, of his own personal, knowledge,
<br /> that C. R. Helber �nd Clarence R. Helber, above referred to, is one and the sams identical
<br /> person, no�Gwithstanding the discrepancy in names.
<br /> Affiant further states th�t he is well a.nd personally acquainted with Elsie A. a�.ersdorf,
<br /> one of the grantors, in a w�.rranty deed, conveyin� the above described premises to Roy
<br /> Ellis and Emi1 Thomssen, whieh deed bears d�,te of Set�tember 16, 1931 and recorded in Book
<br /> 74 at Pa�e 75 of the deed records of Hall County, IJebraska, and with Elsie E. Giersdorf,
<br /> who is na.med as one of the heirs �t lava and devisees in the matter of the estate of Charles
<br /> L. Rickard, deceased, t�rhich estate ��ras duly administered in the County Court of Hall
<br /> County, Nebr�ska, and in Urhich, with special reference to the petition for probate of will,
<br /> in the la,gt ?aill and testament of sa.id dece�sed, and also in tYie final decree entered in
<br /> said esta.te, said Elsie A. Giersdorf is referred to as Elsie E. Giersdorf, but affiant
<br /> positively knotas of his own personal knowled�e, that Elsie E. Giersdorf and Elsie A.

<br /> R�.il�aay Company, a corporation, Cyrus H. McCormick, John Duff, Frederick L. Ames and "any
<br /> and all bersons having or claiming to ha.ve any interest in Lot Eight (�) oP Block Twenty
<br /> one (21)y of the Village of Alda, Nebra.ska, as 9urveyed, platted and recorded, Real Names
<br /> Unknown", and the court havin� ex�mined the records and files herein, and being duly a.dvised
<br /> in the premises, finds that s��.id defendants were duly served ��rith process as required by
<br /> la��r, and th�,t said defendants are in default for answer, demurrer or other pleading, and
<br /> that the plaintiffs are enti�led to their default. .
<br /> IT I�7, TI-iERFF��E, ORDERED, ADJUD�ED AiVD DECREED BY THE COUF�T, that the default of the
<br /> Union Pacific Railway Company, a corporation, Cyrus H. I�IcCormick, Jonn Duff, Frederick L.
<br /> Ames, and "a.ny and all other persons having or clairning to have any interest in Lot Eight
<br /> (�) of Block Twenty one (21) of the Village of Alda, Nebragka, as surveyed, platted and
<br /> recorded, Real Names Unkno�an, Defendants", and each of tnem, be and the same is hereby
<br /> j duly ta.ken and entered herein.
<br /> T�� court furtner finda that the defendant, Union Pacific Railroad Company, has filed
<br /> its disclaimer in this action and th�.t said deYendant does not claim to have any interest
<br /> in the premises described in tne plaintiffs ' petition, and tne court finds that s�id
<br /> defendant h�.s no interest of any nature whatsoever in the said premises.
