<br /> A G R E E M E N T
<br /> This agreement, made and entered �nto, in�tripl�cate, this l�th day of July, A. D. ,
<br /> 19�6, by and be�ween Laura Grein, widow, 204 South Pine Street, arand Islarid, Nebraska,,
<br /> herinafter rePerred to as the Seller, and Ea.rl E. Harwager and Helen a. Harwager, husband
<br /> a,nd wlPe, 1003 North Haltimore, Hastings, Nebraska, hereinafter rePerred to as the Buyera,
<br /> WITNESSETH, The Seller agrees to se11 and convey to the Buyers, as �oint ten ante, and
<br /> not as tenants in common, with the right oP surnivorship, the West Half oP the Northeast
<br /> Quarter of the Northeast Quarter of Seetion 3, in Township 10, North oP R�.n�e 9, West of
<br /> the 6th P. M. , in Hall Cnunty, Nebraska, conaisting of 20 acres, a �lttle more or less,
<br /> aceordin� to government survey thereof, f or the consideratlon o:P �11, 500.04. to be paid
<br /> as follows:
<br /> One-Hundred Dollars in cash, receipt oP whiah is hereby aclinowledged, one-hundred
<br /> dollars on September i, 19�F6 and one hundred dollars on the first day of eaeh and every
<br /> month thereafter, until said consideratlon ia paid in Pull, with Pive percent intereat.
<br /> Seller agrees to furnish the Buyers an abstraet of title, showing a merchantable title
<br /> in her, sub�jeet ta a mortgage oP �5,000.00 3n favor of Joe M. Sprague and E11a M. Sprague,
<br /> which she agrees to pay when the ga.me becomes due and payable, execut� a warranty deed to
<br /> said premises and deliver the same, with a copy of this contract, to the �verland Na�ional
<br /> Bank of Grand Island, Grand Island, Nebrask�,, to be held by sai$ bank in escrow and dellvi�red
<br /> to the Buyers upon payment of the purchase price in full, with all interest.
<br /> The Buyers agree to pay the payments provided herein promptly when due, and in addition
<br /> thereto pay all taxes levied against said land as the same become due and payable, and
<br /> b�fore the ea,me become de2lnquent, and to keep the improvements on said land insured for
<br /> not 2ess than �5,�75.00� which policy is �� be he2d by the mortgagee of the loan now on
<br /> the land, or the said Overland National Hank of Grand Island, with proper clauses attaehed,
<br /> proteetin�; the interests of the parties here�o.
<br /> IT IS FURTHER AGREED, that ou'� of the payment made on September 1, 1946, and the future
<br /> payments on the first day oP each month, there shall be applied the interest due under
<br /> this contract, �nd the balance on the pr3ncipal untll the same ls paid in full.
<br /> IT I8 FURTHER AGREED, that in the event the Buyers are in dePauZt of any monthl�r payment
<br /> for a period of nine'Gy da.ys, then the �eller shall have the option to declare the balance
<br /> due on the contract with interest due and payable at onee, and shall haee the right to
<br /> enter into possesslon of said premisee 3mmediately and to have the right to Po�eclose said
<br /> eontract by strict foreclosure.
<br /> IT IS F URTHER AQREED, �hat the Buyers shal.l have the right to enter into poasession oP
<br /> said premises on August 1, Zg46, and shall be permitted to continue ln poasession thereof,
<br /> as long �,s they make the payments provided herein, and are not in 8,�fault for a period of
<br /> more than ninety days.
<br /> IT IS FURTFiER AGREED, that the Buyers shall have the opt3.on oP paying �100. 00 or any
<br /> mul'�iple thereoP, on the first day of any month, in addition to the regular monthly pay-
<br /> ments provlded for herein.
<br /> IT SS FURTHER A(�REED, that the BuyerB will nat permit waste on said pr�mises, and wlll
<br /> protect �aid premises and the improvements thereon against a11 damages, exeept natural
<br /> ` wear and tear or acts of God. ,
<br /> IT IS FURTHER AGREED, that this agreement and all of its provisions ahall be binding
<br /> upon our helrs, executors, administrators and assigns.
<br /> IN ?�TITNESS WHEROF, the parties hereto have aubacribed their narae on the day and year
