<br /> That Wayne Culp and Rose E. Culp, his wife, and Ed.Ereseh and Aurelia Eresch, his wife,
<br /> of Hall County, Nebraska, in consideration of' �1.00, receipt of which is hereby ack�ow-
<br /> ledged, and the further payment of a sum to make a total payment of �75.00 for Substation
<br /> Lot and poles when set on the following deseribed propert�y, do hereby grant and convey unto
<br /> the Consumers ' Public Power District (hereinafter called �District�' ) its lessees, succ�ssors ;
<br /> and assigns, the �ermanent ri�ht, privilege and easement oP a right-of-way to construct and �
<br /> maintain all necessary polea, wires, guya and other necessary equipment in connection there-
<br /> witn, on and across the following described property situated in Hall �ounty, Nebraska, more
<br /> particularly described as f ollows:
<br /> 24.02 acres located in the Southwest Quaxter (3W4� , Section Nineteen (1�) Township Ten
<br /> (10) North,Range Eleven (11), West, and further identified as Lot Five (5�, County Sub-
<br /> division, of the Town of Wood River.
<br /> The pole line herein contemplated sha.11 be located on the property apt�roximately as
<br /> follozas: Along a North and �outh line East of the Thirty-three (33) foot hi�hway right-of-
<br /> way line on the West side of nroperty and along the North property line. This Easement also
<br /> covers a tract of ground for substation purposes starting from the Northwest corner of Lot
<br /> Five �5) , �.nd measured Forty (4U) feet 3outh along the East Thirty-three (33) Poo'� highway
<br /> ri�ht-of-way line, then East Forty (�0) f eet at a Ninety {90) degree angle, then North to
<br /> the North property line parallel to the starting line, as more specifically set forth on
<br /> the attached Exhibit '�A�� which is a part of this Easement.
<br /> The District shall also have the privilege and easement of ingress and egress across
<br /> the property to its officers and employees for any �urpose necessary in connection with the
<br /> construction, operat3on, maintenance, inspection �,nd removal o�' said line.
<br /> The District sh�,1,1 also have the right at any time t^ trim or remove such trees and under-
<br /> brush as may in any way endanger or interfere with the safe operation of the lines and equ��-
<br /> ment used in connection therewith.
<br /> The District shall a� all t�.ms's . �xerci�e ��11 due care and dili ence to avoid ir�jury or
<br /> damage to the crops, livestock and other personal property of the �rantor, and the District
<br /> shall indemnify and save harmless the Grantor from any such damage and loss arising or occur-
<br /> ring to such property solely by reason of the construction, operation and maintenanee of said
<br /> transmission lines.
<br /> The Diatrict agrees that should the transmis�ion lines con��ructed hereunder be abandoned
<br /> for a �eriod of' five years, the right-of-way or easement hereby secured shall then cease and
<br /> terininate, and this contract shall be of no furthe_r �orce and effeet.
