<br /> LEASE AND AGREE�ENT �
<br />� This agreement made and entered into this 20t7i day of May, 19�-3 by and between Meta
<br />� Stelk, widow, Detlef Stelk, Otto Stelk, Anna Denker and Marie Degen, parties of the first
<br /> part, and Ni. M.Lippincott, party of the second part; Witnesseth:
<br /> That the parties of the first v�rt have this day lease� unto the par'�y of the second
<br /> part the follot�ring described premises, to-wit :
<br /> Lot One (1� on the Mainland of the Southwest Quarter ( SW4) of the Southeast Quarter
<br /> � ( SE4) , Section Fourteen (1��-) , Township Eleven ( 11) North, Range Nine ( 9) , West of the
<br /> 6th P.M. , Hall County, Nebraska
<br /> containing approximately 30 acres, same being property all lying North of the main road
<br /> of the CB & Q Railroad' s right-of-way, for the pumping of gravel for a period of ten
<br /> (10) years from the date hereof, givin� and granting unto the said M.M. Lippincott an option
<br /> �o re-lea.se said premises a�ove d�scribed for an additional period of ten (10) years from
<br /> the exr�iration of this lea.se and agreement under '�he same terms and conditions herein
<br /> folloT�ing.
<br /> �he consideration for the leasing of said premises shall be a minimum sum of �100.Q0
<br /> � per year payable on the 20th d�y of Ma.y, during the entire term of this contrac'�, based
<br /> on the price of �$1.�0 per railroad car for all gravel taken off of said premises or based
<br /> on the payment of 2�¢ per eubic yard if said gravel is being haul�d out by truck. The
<br /> �100.00 payment above referred to shall be credited against the total amount of the gravel
<br /> removed from said premises ana "the said party of the second part agrees that he will fur-
<br /> nish to the said parties of the first part or their agents, a monthly statement of all
<br /> gravel removed fror� 5aid premises and at such times as the amount of gra.vel removed sha,ll
<br /> exceed the payment of the �100. �0, pay��.ble in advance each year, he wi11 settle and pay
<br /> ,� for all additional gravel at inonthly intervals.
<br /> It is fur�her mutually �.greed that the parties of the first part shall have the right
<br /> and privilege to use or lease a11 of said ground not being actually operated as a gravel
<br /> pi� f'or agricultural �urposes and the party of the second part agrees to save the parties
<br /> of the first part harmless from the result of any and all damages, losses or suits arisin�
<br /> � out�of tne actual operation of said gravel pit on said premises.
<br /> No gravel shall be �ranspor�ed fror� any ad,joinirig property owned by other people over
<br /> the above leased land without the consent of the parties of the first part and it is
<br /> . further mutual�.y agreed that tne said p�rty of the secor�d part shall have the right of
<br /> • entry and exi� upon ancl acress that part of' Lot One (1) on the Mainland of the Southwest
<br /> Quarte� of the Southeast Quarter of Section Fourteen (14) , Township Eleven (11) North,
<br /> _ Range 1Vine ( �) , West of the 6th P.P�. , Hall County, Nebraska, lying South of the Main Road-
<br /> way of the CB&Q Railroad to gain access and exit to and from the premises herein leased but
<br /> sh�ll confine the passage to one 30 foot roadwa.y thereon.
<br /> It is further mutually agreed that �he lease sha11 be exclusive to the party of the
<br /> second p�,rt herein as to the lea:`ed premises and no other parties shall have the right to
<br /> pump gravel from said premises unless agreed to by the party of the second part.
<br /> Tha.t the pa�ty of the second part will, within a period of 12 rnonths from the date of
<br /> the signin� of this agreement commence and operate a gravel pit on said leased premises
<br /> and take such steps as are necess�,ry and he shall ha.ve the right to cause a railroad spur
<br /> line to be l�id upon, into and across said premises from the main line of the CB&Q Railroad
<br /> `� Company� s ri�ht-of-way.
