The Seller agrePS to deliver, t.aithout charge to the Buyer, a policy of mortgagee <br /> title ingurance in favor of the Government iesued by such company as the Government shall <br /> �pr�rove, in the amount of the purcha.se price of sa�d property, a.nd to comply with all the <br /> requiremPnts of such comp�ny, including the furnishing of an absract of title �nd continua- <br /> tion tnerFOf �ahere reauirPd. The Seller further agrees tha.t except as herein provided all <br /> taxes, liens, eneumbr<�nces, or other interests in third persons, ?aill be satisfied or dis- <br /> ch�.rged by him, including stamp taxes and othei expenses incidental to the preparation and <br /> execution of the deed and other evidences of title required by the Government. Upon failure <br /> of the Seller to furnish such nollcy of insurance within a reasonable time, the Buyer may <br /> procure such insurance, in which event the cost thereof shall be deducted from the purchase <br /> price herein provided. <br /> 5. The Seller also agrees to secure for tne Buyer from the records of the County <br /> Agricultural Conservation Association, aerial surveys of the farm when available, all <br /> obt�.inable informa.tion relating to allotments and �roduction history, and any other informa- <br /> tion needed in connection �aith the consideration of the broposed purchase of the farm. <br /> 6. The �eller further agrees to convey said lands to the Buyer by general warranty deed <br /> � except where the l�.w t�rovides otherwise for conveyances by trustees, officers of courts, etc. ) <br /> in the form, manner, anc� at the time reauired by the Government, conveyin�* to the Buyer a <br /> valid, unencumbered, indefeasible fee simple title to said lands meeting all requirements <br /> of the Government; that the �urcha.se brice snall be pa.id at the time of re�ording such deed; <br /> that said lands, including improvements ahall be delivered in the same condition as they now <br /> are, customary use a.nd we�r excepted. <br /> (Here insert any different ta.x agreement) <br /> It is �greed that in event the option is exercised the buyer is to receive all of the 19�+4 <br /> rent �nc� to nay the 19�+� taxes. <br /> �. The Buyer will not assume or pay any share of prepaid insurance premiums. <br />, 9. This option may be exercised by the ��3uyer by ma.iling or telegraphing a notice of <br /> acceptance of the offer herein to Wilhelm Tiemeyer, at ----=---, in the city of Utica, State <br /> of Nebra.ska, �t any time while the offer herein shall remain in Porce. The offer herein shall <br /> be irrevoca.ble for a period of three months from the date hereof, and sha.11 remain in force <br /> therPafter until termin�ted by tne Seller. Such termination may be e�fected by the Seller <br /> at any time after the expiration of such period by giving of ten �10) days ' written notice <br /> to the Buyer of such termina.tion. <br /> 10. Loss or damage to the property by fire or from other act of God shall be at the <br /> risk of the Seller until tne deed to the �uyer has been recorded, and in the even� that <br /> such loss or damage occurs, the Buyer may, without lia.bility, refuse to accept conveyance <br /> of title, or elect to accept conveyance of title, in wnich case there shall be an equitable <br /> ad�justment of the purchase ��rice. <br /> (Here insert conditions peculiar to �articular transaction) <br /> 11.
