<br /> LEASE TO THE UNITED STATES OF AMERICA
<br /> BY INDIVIDUAL OR PRIVATE CORPORATION
<br /> THIS LEASE entered into this 10th day of April, 194�+, by and. bet?aeen Alex G.Poul�e�,
<br /> City of Gra.nc�. Island, County of Hall, State of Nebraska, herein called the "LESSOR"� �nd
<br /> THE UNITED STATES OF AMEFICA ACTING BY THE NATIONAL HOUSING AGENCY, herein called the
<br /> ��GOVERNMENT" :
<br /> 1�ITNESSETH:
<br /> The narties hereto for the considerations hereinafter mentioned covenant and agree as
<br /> follows:
<br /> 1. The Lessor hereby lea9es to the Government the Pollowing-described Premises together
<br /> t�rith a.11 imnrovements thereon and appurtenances thereto herein called the ��PREMISES", located
<br /> in the City af Granc� Island, County of Ha11, State of Nebraskaf
<br /> The Northerly 90 Feet of Lots 1 and 2, and the Westerly 21.� F'eet of the south 42 Feet
<br /> of Lot 2, B1ock 122, Koenig and Wiebe ' s Adc�ition, Grand Taland, Ha11 County, Nebraska;
<br /> also kno�an as 1Q01 west First Street, Grand Island, Nebras'_�a.
<br /> 2. �o h�ve and to hold the Premises for a term of seven (7) years, beginning on April
<br /> 15, 1�4�-, and ending on April. 15, 1951.
<br /> 3. The Govern ment shall pa.y the Lessor annual rent, sent to the address provided for in
<br /> �aragra.ph 15 of this lease, of �25�+.00, payable in advance in quarterly installments of
<br /> 63. FO on the 15th day of April, July, �ctober, and January; provided, ho�aever, that the
<br /> first gu�rterly installment of rent under this 1e€�.se ma.y be paid not later than 30 days
<br /> after �ossession of tne lea.sed premises has been delivered to the Government.
<br /> 4. The Government, during the term of this lease, may build, rebuild, remodel, recon-
<br /> dition, rehabilit�te, convert, change, and alter the Premises, and install and m�intain
<br /> a.dt�'itions and structures thereto, inclu�.ing internal and external chan�es, and may change
<br /> the numr�er of livin� units in the Premises and attach fixtures thereto, and make any and
<br /> all improvements thereto, including utilities and roads, at the expense of the Gove.rnment;
<br /> Provided., however, T'nat the�e rights may be exercised in accordance t�rith pla.ns and s�ecifi-
<br /> cations submitted to and a.)�Y�roved in T�rriting by the Lessor. The Government may m�.ke such
<br /> rPasonable variations from and modificatione in, such plans and specifications originall.y
<br /> apnroved by the Lessor as the Government deems necessary in the course of c�rrying out such
<br /> plans and specifications. All such building, rebuilding, remodeling, reconditioning, rehab-
<br /> ilitatin�, converting, changing, and altering of the Premises and all additions, structures,
<br /> and fixtures ac?ded to tn� Premises by the Government, includin� utilities and roads, �ahich
<br /> are remaining thereon at the termination of this lease, however accomplished, or when the
<br /> Government begins reconversion of the Premises, sna.11 then become the l�roperty of the
<br /> Lessor; and. the Government shall be unc�er no obligation to restore or reconvert the Premises
<br /> to their condition at the time of the execution of this lease; Provided, however, That in
<br /> the event the Govern ment determines to terminate this lease, except tahere such termination
<br /> is in purstz�nce of an election made by the Government unc�er the provisions of paragraph 10
<br /> hereof, �.nd the conversion of tnP Premises has been actua.11y commenced but has not been
<br /> com�aleted trle GovPrnment at its �ole option, before such termination becomes effective,
<br /> shall either c�mplete the conversion or restore or reconvert said Premises to tneir condi-
<br /> tion �.t tne time of the execution of this lease; and Provided further, That in the event
<br /> this lease has been t�rmina.ted, except where such termination is effecte�. under thP pro-
<br /> visions of ��asagraph 10 hereof, the Government shall rPstore or reconvert said Premises
<br /> whenever the changes an� <�lterations therein have been of a tem�orary nature and have been
<br /> c�esigna.ted as sv.ch in the plans �nd specifications approved by tne Lessor. The Government
<br /> agrees to hold the Lessor harmless of and from all liens by reason of any building, improve-
<br /> ments, alteratior�s, repairs, reconve��sion or restora.tion.

<br /> water ra.tes, ��rinci�al �nc? interest on liens and other encumbr. ances on tne Premises �,ue

<br /> The (�overnment may, but sh�.11 not be required to, pay on behalf of the Lessor any other
<br /> taxes, asse�sments, municipa,l a.nd governmental rates, water rates, principal and i�terest
<br /> on liens, and oth,er encumbr�.nces on the premises not listed in this pa.ragraph, due and
<br /> unnaic� at the time of the bPginning of tne term of this lease, together with any interest
<br /> and benalties due thereon up to the time of payment, or any additional interest and penalties
<br /> due a.nd unpaid on any items iisted in this paragr�ph u?� to tne time of payment thereof, in
<br /> which event the Government will c�educt tne amount of s�_�ch payment or �a.yments from any rent
<br /> or rent s �.ue or tahich become due to the Lessor. •
<br /> 6. The Government agrees during the term of this lease to pay each year a11 taxes and
<br /> water rates, all assessments � special or improvement) , and municipal or governmental rates,
<br /> i�ahich are levied and imposed upon said Premises, or �ny part thereof, a.nd become due and
<br /> payable during the period covered by tne term of this lease; Provided, however, That the
<br /> Government sna.11 be required to bay only such assessments, or installments of assessments
<br /> ( specia.l or improvement) , which are levied and impoeed upon said Premises, or any p�.rt
<br /> thereof, and which if unpaid �aill become past due and/or delinquent durin� the period
<br /> covered by the term of `this lease, it not being intended that the Government shall pay any
<br /> assessment �ahich may be payable in installments or otherwise, or installments of assess-
<br /> ments ���hich do not mature during the term of this lease. In any ca.se where the Lessor is
<br /> obliga.ted under the terms of a.ny mortgage or lien instrument to m�ke periodic payments to
