<br /> having heretofore made application to the Nebra.ska Loan & Trust Company, Grand Island, Ne-
<br /> braska, for a loan on the premises described below, and in consideration of tne said Trust
<br /> Company m�king said loan and for other good and valua.ble consideration, receipt �thereof
<br /> is hereby acknowledged, do hereby a5sign, and '�ransfer to the said Nebraska Loan & Trust
<br /> Company as addition�l security for 5aid loa.n on tne rents, income and profits arising out
<br /> of the premises described as follows, to-wit:

<br /> Origina.l To�m, now City of Grand Island., Nebraska., according to the official plat
<br /> thereof of record and on file in the office of the Register of Deeds.
<br /> This assignment of rents is made for the expreas purpose of having the income from the
<br /> said premises applled to the repayment of tne above described loan and the interest there-
<br /> on, delinquent taxes, and insur�nce premiums which may be charged against the a bove
<br /> Aremises.
<br /> Said Company may, in its descretion, use said rents for the p�yment of Gaid loan or
<br /> the accrued interest thereon or delinquent taxes or payment of insurance premiums as it
<br /> may deem best.
<br /> We hereby authorize and em�ower the Nebraska Loa.n & Trust Company, its oPficers, agents
<br /> or attorneys to act for us in the collection of the rent from all of sa.id premises and to
<br /> receipt for s�.id rent and to agree upon the prices of the rental to be paid, and loak after
<br /> the renting of said premises.
<br /> IT IS FURTHER AGREED that if the undersigned assignors or their successors, occupy
<br /> said premises during the existence of' said loan, the assignee shall have the same rights
<br /> of forPeiture, e,jectment for forcible entry and detainer and such other actions as it
<br /> would have aga.inst any tenant occupying said premises and ha.ving no interest therein.
<br /> The Truat Company may have the right to waive the collection of any part of said rent and
<br /> if it does so, it shall not be construed as substituting a relinquishment of any of the
<br /> rights given under this assignment, but said rights may be exercised at any time said
<br /> Trust Company deem� it advisable to do so and said rights shall continue as long as the
<br /> mort;age or interest or any p�rt thereof remains a lierl against said premises.
<br /> IT IS FURTHEr AGREED tha.t the said Trust Company sh�.11 not be liable for the loss of
<br /> the collection of any rents and said Company is only required to use reasonable diligence
<br /> in collecting said rents and in the management of said property. The Trust Company shall
<br /> h�ve tne right to deduct from said rents a fair a.nd reasonable compensation, such as
<br /> expense, court costs, ancl collection coats, which are incurred during the term of this
<br /> assignment and after deducting �'or the services, court costs and other expenses incurred,
<br /> the bala,nce shall be applied to the payment of the balance due on the loan, or interest,
<br /> or taxes, or insurance premiums in the manner in which said Trust Company shall deem best.
<br /> This assignmPnt shall be irrevocable and shall remain in force until the a.bove described
<br /> loan a.nd interest, delinquent taxes and insurance premiums thereon shall be paid and until
<br /> 9�id mortgage is satisfied in full and released.
