<br /> �. The (�overnment, d.uring the term oY this lease, aha11 take good care of the Premises,
<br /> and may make any and all repairs, both interior and exterior, neceasary to ��ep the Firemisea
<br /> in good order, condition, and repair, without the consent or approval of the Lessor. Upon
<br /> the surrender of the premiees by the C�overnment, it shall redtcorate and/or repaint the
<br /> vacant portion oP the interior thereoP.
<br /> 10. Whenever the whole oP said premises or any essen�ial part thereof sha.li be destroyed
<br /> by any cause whatsoever, the (�overnment hae the right and privilege to rebuild, reatore, or
<br /> repair sRid Premises or elect to terminate the lease. In the event oP eZection to terminate
<br /> thia lease, the aovernment shall �ive notice in writin� of intention to terminate to the
<br /> Lessor within sixty �60) daye after such destruction, in whole or in any essential part, and
<br /> the inatallment af rent p�.yable for �he period during which the �ermination occurs ahall be
<br /> prorated. �
<br /> 11. The aovernmen� may terminate tYiis lease at any time during the term thereof by giving
<br /> to the Leeaor thirty 30) daye ' written notice oP such intention to terminate. In the event
<br /> of such termination, the installment of rent payable for the period during whieh the terarina-
<br /> tion oc�^ure ahall be prorated.
<br /> 12. The C�overnment may a$si�n or subleb all or any part of the Premises to tenants,
<br /> oecupanta, or other persons, whom it may select, and such assigneee or sublesseea sha.11
<br /> ha�re eueh oY the rights granted to the ao�rernment under this lease as the aovernment m�.y
<br /> grant to such assignees or sublessees.
<br /> 13. The Lessor may put up pFor Rent� signs Plfteen �7.5) da.ys prior to the termination
<br /> by the aovernment oP its tenancy.
<br /> 14. The Lessor with the intention that the c}overnment shall rely thereon and for the
<br /> purpo�e of inducing the aovernment to enter into thia lease represents, states, covenants,
<br /> �.n8 warrants that he � she) (it) (they) has�have a right to enter into this lease and has/have
<br /> a good and marketable title to the Premises as followa:�C Fee simple title in Lessor,
<br /> Malvina MeCann.

<br /> Mortgage lien as shown at paragraph 7, sub-section 1, above.

<br /> 15. All notices provided for by this lease may be given by regular mail addresaed to
<br /> the Lessor at 722 West �harles, Grand Island,Nebraska, or to the (�overnment with prepaid
<br /> poata�e addressed to THE UNITED 3TATES OF �iMERIGA - NATIONAL HOUSING AaENCY at, �HOLC,
<br /> W.O.V�. Building, �maha, Nebraska.
<br /> �ub��ect to the right of either the Lesaor or the aovernment to designate by notice in
<br /> writin$ a new address to which said notices must be sent.
<br /> 16. The Lessor expresaly covenants and agrees to deliver posseasion oP the Premises
<br /> to the Qrovernment Pree oY oecupanay by any tenant or any other person on or bePore the
<br /> t'lrst day of the term of this lease. , �
<br /> 17. This lease ahall be binding upon the Lessor, his (her) (its) ( their) heirs, execu-
<br />� tora, administrato�s, grantees, suCCessors, and assigna.
<br /> 1S. No Member of or Delegate to the Congress or Resident Commissioner shall be admltted
<br /> to any share or part of thie contract or a�reement, or to any benePit to arlse thereupon.
<br /> 19. Notwithetanding any provisions of this lease to the contrary, it 1e agreed and
<br /> underatood"between the C�overnment and the Lesaor that the t�vernment will not make any
<br /> payments outlined in any paragraph hereot until the Lessar dellvers to the t�overnment
<br /> full possesai.on of the Premisea in the same condition as said Premises were in at the
<br /> time of execution of this lease. It is �'urther agreed and underatood between the (�overn�-
<br /> ment and the Lessor that the aovernment will not assume to make any sueh payments if the
<br /> Lesaor breaches his covenant set Porth in paragraph 16 hereof to deliver possession oP the
<br /> PremisPS on or before the firat day of the term as speviPied in paragraph 2 hereof.

<br /> soiicit or secure thia lease upon any agreement �or a commission, percentage, brokerage, or
<br /> eontingent f ee. Breach of this warranty ahall give the aovernment the r�ght to annul this
<br /> lease or in its discretion to deduct from any amount pa�able to the Lessor the sum of such
<br /> aommission, percentage, brokerage, or contingent fees. Thla warranty shall not apply to
<br /> oommissions payable by the Lessor upon contracts ma.de through bona fide established com-
<br /> mercial or�selling or rental agencie� maintained by the Lessor Por the purpose of ' securing
<br /> business.
<br /> 21. It is agreed that this lease embodiea the whole agreement of the parties, ar.d that
<br /> there axe no promisee, terms, conditions, or obligations referring to the sub�ect matter
<br /> other than those contained herein.
