<br /> THIS AGREEMENT, made and entered into this 29th day of March, 19�3, by and between
<br /> Jacob B.Hellman and Francea V.Hellman, husband and wife, in the county of Ha11, State of
<br /> Nebraska, parties of the first part, and Fred L. Gillet and Elizabeth aillet, husband and
<br /> wife, in the county of Hall and State of TJebraska, , parties of the second part:
<br /> WHEREAS, th? said �arties of the first part are the owners of the North One-Half(N�)
<br /> of Lot One �l) in �lock Eleven �11) of Kernohan and Decker ' s Addition to the C�ty of Grand
<br /> Island Hall County Nebraska, and the said parties of the second part are the owners oP
<br /> the south One-Half � ��) o? sa,id Lot One �1), 'which half lots are ad,joinin�;; and
<br /> WHEREAS, a double garage has heretvf'ore been erected on said �remises, d�ne-half on the
<br /> south half of s�id lot and one=half on the north half thereof and used by the respective
<br /> owners of said two half lots, with a single concrete driveway extending from the east side
<br /> of said garage e�,st to Madison Street, and one-half of which driveway is on each half lot;

<br /> WHEREAS, the aforenamed parties, considering that it will continue to be a benefit to
<br /> the owners of sa.id two half lots to continue to maintain and use said driveway ,�ointly so
<br /> long as a garage is maintained on the two half lots �nd used by either or both owners there-
<br /> of, do, for themselves, their several heir5, executors, adminietrators and assigns, covenant
<br /> �nd agree, QACh with the other, por the purx�ose of continuing and maintaining and using said
<br /> driveway as aPoresaid, th�t parties of the first paxt �aill, and by these presents do, grant
<br /> to narties of the secend �art �.n easement and right to drive over such uortion of the south
<br /> encl of said North One-Half (N2) of said Lot One as is now used as a mutual driv�way, Prom
<br /> Madison Street to the garage, and that parties of the second pa,rt will, and by these presents
<br /> do, grant to ��r. ties of the first �a,rt an easement and right to drive over such portion of
<br /> the Nor.th end of said South One-Half ��) of' said Lot One as is now used as a mutual cirive- �
<br /> way, from Madison Street to the garage. �
<br /> The parties hereto also, mutually agree th�.t eaeh party and his respective successors
<br /> in title shall be entitled to use the driveway in cammon, ar�d the expense of maintalning ,
<br /> it, together with such portions of tn.e gara.�e as c�n be considered used mutually an�.11 ,
<br /> always �e equally borne by the parties hereto, their respective successors in title, and
<br /> assigns. It is furt�_er agreed neither �arty will un,necessarily obstruct or permit the
<br /> obstruction of s�id driveway or any part thereof. 8�iould the land hereby sub,�ect to this
<br /> easement ever cease to .be used as a driveway, then in such case, tne Pull right and title
<br /> shall revert to the �resent owners or their respective successors in title.
<br /> Tn further consideration of the mutual promises and agreementa of the parties, the
<br /> � p�rties of the first part hereby gr�.nt unto parties of tne second part, their heirs and
<br /> assigns, an easement over and across said North onP-half of said Lot One �l) for the ,
<br /> m�intenance of any ��a.ter and gas pipea and othPr uti,llties now on said premises serving
<br /> the South one-half of sa.id Lot One �l) and the parties of the second part hereby grant
