<br /> THIS AGREEMEN'I', rnade and entered into this 30 day oY March, �943, by and between
<br /> William H.Qu�.11in, �. Widower, party of the first part, and the CITY OF GRAND I9LAND,
<br /> NEBRASKA, a �unicipal Corporation, party of the second part, WITNESSETH:
<br /> WHEREAS, the party of the first part is tne owner of the following deseribed real
<br /> estate, to-wit: _ •
<br /> Lot One (1) ,Wilaons subdivision, located in Section Three �3) , Township El�ven �11)
<br /> North, Range Nine �9) West of the 91xth Principal Meridian, Hall County, Nebraska, and
<br /> WHEREAS, the second party desires to construct, operate, renew and maintain an
<br /> electrie transmission line over, upon �nd across said real estate,
<br /> NO'�J, THEREFORE, in consideration of the covenants hereinafter set forth to be performed
<br /> by the party of the second part and the payment tv be m�.de by the party o� the second part,
<br /> the party of the first part hereby grants and conveys unto the party oP the second part,
<br /> its suecessors and assigns, the right, privilege and easement of a ri�ht-of-way to construct,
<br /> operate, renew and maintain a power line together with all equipment in connection there-
<br /> with, for the transmission of electrical energy on and across the property heretofore des-

<br /> The transmission line and all equipment in connection therewith herein contemplated
<br /> shaTl be located on said property as follows:
<br /> Said line ahall enter the premises on the north line of said Lot One at a point

<br /> 2411.1 feet west and 2 Peet south of the northeast (NE) corner o_ Section �'hree
<br /> (3) Township Eleven �11) North, Range Nine �9) , West of the 6th P.M. Hall County,
<br /> Nebraska, said section corner being the Northeast (NE� corner of Lot One �l) of said
<br /> wilsons subdivision; Thence running in a Southwesterly (3�) direction upon and aeross
<br /> said Lot One �1) , a distance of 1427 feet to a point 922.�F �eet South and 51 feet East
<br /> of the Intersection of the Section Line between Sections Three �3) and Thirty-four (3�-)
<br /> and the center line of the Union Pacific Railroad Company 's right-of-way, Thence in a.
<br /> southerly direction parallel with the center line of the Union Paeific Ra.ilroad Com-
<br /> pany ' s right-oP-way a distance of 731.6 feet to a point on the �outh line of said Lot

<br /> The line over and across the said prernises to be a one circuit 13,200� volt, three wire t
<br /> �ower line constructed on 30 f�pt, class 5 W.R. C.A. poles, wire size #6 H. D. bare wire on
<br />' � pin standard T�. E.L.A. arms, said line being supported by 14 polea located on the said

<br /> TO HAVE AND TO HOLD the same unto the party of the second part Prom the date hereof
<br /> and until the second party, its successors or assigns, permanently abandons the use oP
<br /> sai� premises for the purpose herein set Porti�, and the second party, in consideration
<br /> ofa°gran'� hereinbefore set forth, agrees to pay to the first party the sum of �30.00, re-
<br /> - ceipt of which is hereby acknowledged.
<br /> Party of the� second part shall have the privile�e and easement of ingress and egress
<br /> across the nroperty by its officers and employees or any purpose necessary in connection
<br /> with the construction, operation, maintenance and inspection of s•aid line.
<br /> The Party of the second part sh�ll h�.ve the right at any time to trim or remove such
<br /> trees, hedges, or underbrush, as may in any way enda.nger or interfere with the safe and
<br /> successful operation of the line and equip�ent usA$ in connection therewith.
<br /> The party of the second part as�umes responsib�.],i�ty for a.11 damage to property and
<br /> growing crops caused by any of ita employees working on or insp�eting the line or by
<br /> reason of the failure of any pole, structure, wire or other appurtenants or equipment,
<br /> being a part o�' such line. Party of the second part agrees to restore all fenees broken
<br /> down or in,jured in a manner covered by the foregoing clause. •
