<br /> THIS AGREEMENT, entered into this 11th day of February, 193�, by and between Catherine
<br /> Wiese, J.L. Cleary and C.E.Grundy, Executors of the Estate of Rachel �.�eCann, deceased, and
<br /> Thomas O�Hara, parties of the first part, h�reinafter known as grantors, and Matilda M.
<br /> Strasser, party of the second part, hereinafter known as Trustee,

<br /> • WHEREAS, the notea securing said mortgage, in the amounts of four note's of �2500. : ea�eh,
<br /> have been assigned, without recourse to the above grantors in the following respeetive
<br /> amo�znts; �5000. to Catherine Wiese, �2500. to �a.chel ��eCann and �2500. to �homas O�Hara,
<br /> said notes being e�ch equitablr secured by said mortgage and of equa7. right and priority,
<br /> and .
<br /> WHEREAS, �.R.Benton, Trustee, present owner of the above described property, sub',�eFt
<br /> to the above mentioned mortgage, desires to deed said property to tne owners of the notes
<br /> and in consideration thereof to rele�.se the liability of said mortgage. �he above �lentioned
<br /> grantors agree among themselves and with the Trustee hereof, that they wi11 aecept said
<br /> land by virtue of acceptance of a warranty deed from the said 3.R. Benton, Trustee, to
<br /> Ma.tilda M. Strasser, Trustee for the benePits of the above mentioned grantors in the pro-
<br /> portions as their respective interests in the mortgage shall bear; that ?�s, the said
<br /> Trustee hereoP shall hold the above mentioned land for the benefits of Catherine W��ese,
<br /> one-half, the Raehel MeCann Estate, one-fourth, and �homas 0'Hara, one-fourth, and that
<br /> each benePiciary o�' this agreement in quintupllcate shall receive a copy of the same,
<br /> which sha.11 be considered a beneficial certificate Prom the Trustee for their respec�ive
<br /> interests in said land; that is, one-half to Catherine Wiese, one-Pourth to the Rachel
<br /> McCann Estate, and one-faurth to '�homas O�Hara.
<br /> FURTH�R MORE, it is hereby agreed by alI parties hereto that said l�atilda �trasser,
<br /> as '�rustee, shall handle said land for the benefit of the said benePiciaries leaeing same,
<br /> and that the said rents or income Prom said land sh�.11 revert to the said beneficiaries as
<br /> to tY�eir beneficial interest in same aPter dedueting expenses, taxes, ete. , with a
<br /> reasonable fee to be allowed to the �'rustee, as agreed upon by said beneficiaries. It being
<br /> further a�reed that in case the Trustee desires 'to seZl said land, receiving a reasonable
<br /> offer theref'ore, the same ahall only be sold upon the unanimous agreement of all benefi-
<br /> ciaries hereof, the ne� proceeds from the sale of said land being distributed to the bene-
<br /> ficiaries hereoP according to their beneficial interests as above outlined.
