<br /> This cause coming on to be heard upon Motion of Joseph T.Votava, United States Attorney,
<br /> in and for the District oP Nebraska, and Lloyd W.Kelly, 9pecial United States Attorneq,
<br /> attorneys for the Petitioner herein, to en�er �udgment on the Declaration of Taking filed
<br /> in the above entitled cause on Aug. 19, 19��, and for an Order fixing the da.te when pos-
<br /> sessiort oP the property herein described is to be surrendered to the United 3tate8 oP
<br /> America, and upon consideration thereof, and oP the Condemnation Petl;tion filed herein, and
<br /> the statuteg in sueh case made and provided, and it appearing to the satisfaction of the
<br /> . Court:
<br /> First: That the United States ot` America is entitled to acquire property by eminent
<br /> domain for the purposes as set out and prayed in said �'eti•tion.
<br /> seconcl: That a pe'�ition in condemnation was filed at the requeat of the Secretary oP
<br /> War, the authority empowered by law to acquire the lands described in said Petition, and
<br /> also under authority of the Attorney General of the United States.
<br /> Third: That said Petit;ion and Declaration of Takin� atate the authority under which,
<br /> and the public use Yor wh�ch said landa were taken, that the Secretary of War is the person
<br /> duly authorized and ermpo� red by law to acquire lands such as are described in the Petition
<br /> Por the purpose of provid ng for an ordnance munitiona plant and Por other military purp oses
<br /> incident thereto, as auth' r1a�. by law, and that the Attorney General of the United States
<br /> is the person a�'�horized b'3� law to direct the institution oP such condemnation proceeding.
<br /> P'ourth: '�hat a proper deacription of the land sought to be taken, sufPicient Por iden-
<br /> tification thereof, ls aet out in said Declaration of Taking.
<br /> Fifth: That said Dealaration of Taking contains a statement of the estate or interest
<br /> in said lands taken for said public uae.

<br /> Seventh: That a statement is contained in said Declaration oP Taking oP a sum of money,
<br />. estimated by said aequiring authority to �e ,�ust compensation for sald lands, in the amount
<br />. of �29, 300.�?0, and tha� said sum waa deposited in the Registry of this Court, for the use
<br /> o�' the parsons entitled thereto, upon and at the time of the filing of said Deelaration of
<br /> Taking.
<br /> EIGHTH: That a atatement is contained in said Deelaration of Taking that the amount of
<br /> the ultimate award of compensation for the taking of said property, in the opinlon of the
<br /> sa7.d See�etary of war will be within any limits preserlbed by Congress as to the price to
