<br /> KNOW ALL MEN BY THESE PRESENTS THAT:
<br /> WHEREAS, The Federal Land Bank of' Umaha is the owner and holder of a certain r eal
<br /> estate mortgage executed by (�ertrude Cowgill as mortgagor( s) , given to secure a certain
<br /> amortization note of �3600.00, and constituting a lien upon certain real eatate described
<br /> in the mortgage instrument, situated in the County of Hall, State of Nebraska, and which
<br /> mortg�.ge is record�d in Book 77, of Mortgages, Page 79 of the records of Hall County; and
<br /> WHEREAS, The Federal Farm Mortgage Corporation is the owner and holder of a certain
<br /> real estate mortg�.ge executed by aertrude Cowgill as mortgagor� s) given to secure a certain
<br /> amortiz�.tion note of ��00.00 and constituting a lien upon certain real property described in
<br /> the mortg�.ge instrument, situated in the County of Hal1, Btat� of Nebraska and which mortgage
<br /> is record�d in Book 77 of Mortgages, Page �I, of the records of Hall County; and
<br /> WHEREAS, Gertrude Cowgill and Olin Cowgill were the record owner( s) of said real estat�
<br /> on the 27th day of November, 1940; and as grantor( s) , executed and delivered on that date
<br /> to the AMERICAN TELEPHONE AND TELEGRAPH COMPANY OF NEBRASKA, itg assocated and alli�d
<br /> companies, its and their respective succ�ssors, assigns, lessees and agenta, a grant of
<br /> right of way and easement to construct, operate, maintain, replace, and remove a communi-
<br /> cation aystem or- systems upon, over and under the sa.id real estate, which grant of right
<br /> of way and easement is recorded in Book T-Misc. , Page 2�7, of th� reeords of '�he County o�

<br /> WHEREAS, the mortga$e( s) above constitute�s ) a lien on said real estate, including the
<br /> int'erest conveyed in same by the grant of righ'� of way and easement above referred to; and
<br /> WHEREAS, it is the desire of all parties that the rights acquired by virtue of said
<br /> grant of right of way a.nd easement be free and clear of the lien of said mortgage( s) .
<br /> NOW, THEREFORE, in eonsideration of the sum of One Dollar and other good and valuable
<br /> consideration, said consideration to b� applied on the indebtedness secured by the a bove
<br /> mentioned mortgage� s) , receipt of which is hereby acknowledged, the undersigned hereby
<br /> consents and agrees that the l�en of said mortgage( s) upon said real esta�e covered by
<br /> said ri�ht of way and easement may be sub,ject and inferior to the rights of the owner of
<br /> said easement acquired by virtue thereof, and that said rights conveyed shall be free and
<br /> clear of the lien of sald mortgage� s) , except as herein set forth. '
