<br /> In the accepta.nce of this easement, the said State of Nebras'�.a agrees that it will
<br /> surrender and deliver t�rithout cost to said Chicago, Burlington & Quincy Railroad Company,
<br /> its successors or assigns, possession of the premises hereinabove described, in case the
<br /> same sh�ll be abandoned for active highway pur�oses.
<br /> In the acceptance of triis easement, the sa_id State of Nebraska further agrees to sa.ve
<br /> said Railroad Company h�rmless from any and all loss or damage to fences, trees, shrubbery
<br /> or other nroperty of said State oP. Nebraska or others, caused by or growing out of fire
<br /> started from spa.rks from locomotives or otherwise, on lands �covered by this easement.
<br /> The sa.id 5tate of Nebraska in the acceptance of the easement herein granted, also
<br />` a�;rees that it ��rill at its own sole cost and expense and without cost to said Railroad
<br />� Compa.ny �.o all the necessary grading, provide adequate drainage satisfactory to s�.id

<br />�� Railroad Company ana furnish all material and labor necessary for the eonstruction or re-

<br />; construction of' said highway, and shall also at i�s oT�rn expense make or ca.use to be m�.de,
<br /> any changes or alterations in the location or construction of the improvements of said
<br /> Railroad Company made necessary by the easement herein granted, or by the location, con-
<br /> struction and operation of said highway thereon.
<br /> The said Railroad Company does not warrant its title to the premises covered by the
<br /> easement herein granted, nor undertake to defend said State of Nebraska, in the peaceable
<br /> en,joyment thereof.
<br /> IN WITIVE5S WHEREOF, the Chicago, Bur1ln�;ton & Quincy Railroad Company has c�used its
<br /> corporate na.me to be hereunto signed by its Executive Vice President and its corporate seal
