<br /> KNOW ALL JuIEN BY THESE PRESENTS:
<br /> THAT dVHEREAS, Ernest Ostermeier died leaving a Last
<br /> Will and Testament, which Last Will and Testament has been
<br /> admitted to probate in the County Court of Hall County,
<br /> Nebraska, which Court had 3urisdiction, and which probate has
<br /> never been set aside nor appealed from; and
<br /> WHEREAS, the Xth paragraph of said Last Will and Testamest
<br /> read as follows:
<br /> "In the event my said wife shall not survive me, or upon
<br /> her death I do hereby grant to my beloved daughter, Olga Kay,
<br /> as Trustee, however, for the use and benefit of my son, Ervin
<br /> Ostermeier, an option to urchase the Southeast Quarter (SE%)
<br /> of Section Twenty-two (22�, in Township Twelve (12) North,
<br /> Range Nine (9) , West of the 6th P.M. in Hall County Nebraska,
<br /> at the price of Twelve Thousand Dollars ($12,00O,OOj and in
<br /> the event my said wife shall not survive me, the North Half
<br /> of the Northeast Quarter (N'/NE%) of Section Twenty-nine (29) ,
<br /> Township Twelve (12) North, Range Nine (9) , West of the 6th
<br /> P.M. , in Hall County, Nebraska, at a price of Six Thousand
<br /> Dollars ($6,000.00), provided she shall exercise said optior�
<br /> on or before six months after the death of the last one
<br /> dying of myself and my beloved wife." And,
<br /> WHEREAS, the said Olga Kay resigned as Trustee, which
<br /> resignation has been filed in and accepted by the County Court
<br /> of Hall County, Nebraska, and Albert H. Ostermeier was by the
<br /> County Court of Hall County, Idebraska, appointed as successor
<br /> Trustee to act in place of the said Olga Kay as ?rustee for
<br /> Ervin Ostermeier; and
<br /> WHEREAS, Marie Louise Ostermeier died on the 18th day
<br /> of October, 1960; and
<br /> WHEREAS the said Albert H. Ostern►eier, as Trustee for
<br /> the said Ervin Ostermeier, desires to and has exercised said
<br /> option this date; and
<br /> WHEREAS, We, the undersigned, Ernest H. Ostermeier and
<br /> Edward Huwaldt are now the duly appointed, qualified, and
<br /> acting Executors and Trustees of this estate;
<br /> NOW 'IHEREFORE, In Considea�tion of the pre�nises, and in
<br /> consideration of the sum of $18,000.00 in hand paid by Albert
<br /> H. Ostermeier, as ?rustee for Ervin� Ostermeier-, the receipt
<br /> whereof is hereby acknowledged, we, pursuant �..tmi� the powers
<br /> granted to us by law and in the Last Will and Testament of
<br /> Ernest Ostermeier, do hereby grant, bargain, sell, convey
<br /> and confirm unto the said Albert H. Ostermeier, as Trustee
<br /> for Ervin � Ostermeier, the following described premises
<br /> situated in the County of Hall, State of Nebraska, to-wit: -
<br /> Southeast Quarter (SE%) of Section Twenty-two (22) ,
<br /> Township Twelve (12) North, Range Nine (9) , West
<br /> of the 6th P.M. , Hall County, Nebraska; and
<br /> North half of t�e Northeast Quarter (N' !4) Qf Se�ction
<br /> Twentx-nine (29), Tov+nship ?welve (12) No�th, Range
<br /> Nine (9) , West of the 6th P.M., Ha11 County, �ebraska-,
