<br /> KNOW ALL MEN BY THESE PREBENTS`s
<br /> THAT, WHEREAS, Ernest Ostermeier died leaving a Last Will
<br /> and Testament, which Last Will and Testa�ent has been admitted
<br /> to probate in the County Court of Ha11 County, Nebraska, which
<br /> Court had jurisdiction, and which probate has never been set
<br /> aside nor appealed from; and
<br /> WHEREAS, the IXth paragraph of said Last Will and Testa-
<br /> ment read as follows:
<br /> "In the event my said wife shall not survive me, or upon
<br /> her death, I do hereby grant to my beloved son, Albert Ostermeier,
<br /> an option to purchase the Southwest Quarter (SW�) of Section
<br /> Twenty-one (21) , Township Twelve (12) North, Range Nine (9) ,
<br /> West of the 6th P.M. in Hall County, Nebraska, at the price
<br /> of Sixteen Thousand Dollars ($16,000.00) provided he shall
<br /> exercise said option on or before six (6� months after the death
<br /> of the last one dying, of myself and my beloved wife," And,
<br /> WHEREAS, Marie Louise Ostermeier died on the 18th day of
<br /> October, 1960; and
<br /> WHEREAS, the said Albert Ostermeier desires to and has
<br /> exercised said option this date; and
<br /> WHEREAS, we, _the undersigned, Ernest H. Ostermeier and
<br /> Edward Huwaldt are now the duly appointed, qualified, and acting
<br /> Executors and Trustees of this estate;
<br /> NOW, THEREFORE, in consideration of the premises, and in
<br /> consideration of the sum of $16,000.00 in hand paid by Albert
<br /> Ostermeier., the receipt whereof is hereby acknowledged, we,
<br /> pursuant to the powers granted to us by law and in the Last Will
<br /> and Testament of Ernest Ostermeier, do hereby grant, bargain,
<br /> sell, _ convey, and confirm unto the said Albert Ostermeier, the
<br /> following described premises situated in Hall County, Nebraska,
<br /> to-wit:
<br /> Southwest Quarter (SW/) of Section Twenty-one (21)
<br /> Township Twelve (12) North, Range Nine (9) , west
<br /> _._ , _ ._of the 6th P.M. , Hall County, Nebraska;
<br /> together with all the tenements, hereditaments and appurtenances
<br /> thereunto belonging;
<br /> TO HAVE AND TO HOLD the above described pre�ises with the
<br /> appurtenances unto the said Albert Ostermeier and his heirs
<br /> forever. �
